Mithin ist die Bestellung zum Geschäftsführer mit haftungsrechtlichen und strafrechtlichen Risiken verknüpft.Gemäß43 GmbHG haftet der Geschäftsführer für alle Schäden am Vermögen der GmbH, die er durch eine schuldhafte Pflichtverletzung, also aus einem Handeln in Ausübung seiner Funktion als Geschäftsführer, verursacht.
