Die vorliegende Ausarbeitung eines Bankensyndikus untersucht die Wechselwirkung zwischen dem Kontrahierungszwang und den Beschränkungen der Privatautonomie der Banken in Theorie und vor allem in der Bank-Praxis, wobei das seit 2016 geltende Recht der Verbraucher auf ein sogenanntes Basiskonto nach dem Zahlungskontengesetz (ZKG) im Mittelpunkt steht. Der Autor befasst sich praxisorientiert mit der Umsetzung der Vorgaben des ZKG durch die Banken, insbesondere mit der Problematik der Hà he der "angemessenen" Kontoführungsgebühren. Darüber hinaus untersucht die Arbeit die allgemeine Bedeutung von Bankkonten im täglichen Leben, die rechtliche und politische Diskussion, die letztlich zum Erlass der EU-Richtlinie und des ZKG geführt hat. Ein weiterer Schwerpunkt der Untersuchung ist die Darstellung weiterer - den Kontrahierungszwang flankierenden - Vorgaben und konkreten, praktischen Problemstellungen die sich im Rahmen des Anwendungsbereichs, Vertragsschluss, Ablehnung und Kündigung von Basiskonten ergeben. Hier zeigt sich sodann, wie das zu Grunde liegende Recht - die Vorgaben des ZKG - "gelebt" werden. Neben der Umsetzung der EU-Richtlinie in Deutschland durch das ZKG wird auch ein kurzer rechtsvergleichenden Ãberblick zur Umsetzung in den anderen EU-Staaten gegeben. Dargestellt wird auch, dass im Bereich des Bankrechts neben den Regelungen des ZKG auch weitere Entwicklungen stattgefunden haben, die die Vertragsgerechtigkeit und die Gewährleistung der Privatautonomie von Kreditinstituten in der Vergangenheit des Ãfteren in mehreren Bereichen in Frage gestellt haben. Bis heute ist das Thema der "finanziellen Inklusion" durch die Mà glichkeit für Jedermann zum bargeldlosen Zahlungsverkehr von grà Ãter Relevanz. Da bis heute in Deutschland - im Gegensatz zu anderen europäischen Staaten - immer noch nicht geklärt ist, welche Entgelte als angemessen gelten, scheint der durch Kontrahierungszwang verankerte Verbraucherschutz des ZKG entgegen aller Bemühungen fehlzuschlagen. Es ist in der Praxis eine Entwicklung absehbar, dass sich allein über die Entgelthà he für das Basiskonto de facto der alte Rechtszustand vor Inkrafttreten des ZKG durchsetzen lässt, d. h. ein Zustand ohne einen solchen weitgehenden Kontrahierungszwang.…
