Dieses Phänomen des sogenannten Neuroenhancements ist in den vergangenen Jahren weltweit zu einem brisanten Thema geworden und vor allem bei denjenigen Personengruppen stark verbreitet, die unter einem erhà hten Stress, Erfolgs- und Zeitdruck stehen. Wurden traditionelle Leistungssteigerungen noch ausschlieÃlich oder zumindest primär vom Handeln der Betroffenen bestimmt, so ist zunehmend die Mitwirkung Dritter mà glich und erforderlich, vorliegend diejenige von Ãrzten oder Pharmazeuten. Damit wird auch strafrechtlichen Regulierungen ein erhebliches Feld erà ffnet, denn die Grenzziehung zwischen gesellschaftlich akzeptierter Selbstoptimierung einerseits, dem Schutze des Betroffenen vor sich selbst oder der Sicherung von Interessen Dritter anderseits, wirft nicht nur medizinische, sondern vor allem auch ethische und hieran anknüpfend rechtliche Fragen auf. Aus diesem Grund bedarf es einer rechtlichen Klarstellung, ab wann einem derartigen Enhancement im Kontext des Arzt-Patienten-Verhältnisses gegebenenfalls auch mit dem schärfsten staatlichen Instrument, dem Strafrecht, entgegenzutreten ist. Kernziel dieser Untersuchung ist es deshalb, die Strafbarkeit des Arztes im Rahmen des pharmakologischen Neuroenhancements fachlich aufzuarbeiten und dabei die Frage zu klären, inwieweit sich der behandelnde Arzt bei der Verabreichung bzw. Verschreibung von Psychopharmaka zur Optimierung der Gehirnleistung gegenüber dem gesunden Patienten zu verantworten hat. Zudem wird erà rtert, welche Bedingungen an eine wirksame Einwilligung des Patienten geknüpft werden müssen, um mà glicherweise eine strafbefreiende Wirkung zugunsten des Arztes zu erreichen. Um eine schlüssige Einordnung im System einer umfassenden Rechtsordnung vorzunehmen, wurden wichtige medizinische sowie ethische Aspekte berücksichtigt. Insofern flieÃen in die Strafbarkeitsprüfung auch die unterschiedlichen Intensionen für eine Verwendung von Neuroenhancern, deren Einsatzgebiete, die unterschiedliche Wirkungsweise sowie damit verbundene Risiken ein.
