Mit dieser Wertung scheint die Rechtsfigur objektiver Strafbark…eitsbedingungen unvereinbar. Denn im Falle des Bedingungseintritts schützen Unkenntnis, fehlender Verwirklichungswille, Unvorhersehbarkeit etc. gerade nicht vor Strafbarkeit. Da objektive Strafbarkeitsbedingungen konstruktiv die Möglichkeit der Umgehung des Schuldgrundsatzes eröffnen, zählen sie - nicht ohne Grund - zu den 'Problemzonen' des modernen Schuldstrafrechts.Im 'Allgemeinen Teil' der Arbeit wird das Schuldprinzip einer eingehenden Analyse unterzogen. Ansatzpunkt ist dabei die 'philosophische' Freiheitsfrage. Nach Offenlegung des Vorverständnisses strafrechtlicher Schuld wird die spezifische Problematik objektiver Strafbarkeitsbedingungen erörtert. Ein den Gang der Untersuchung tief beeinflussendes Ergebnis besteht in der Erkenntnis, daß Schuld, Gerechtigkeit und Prävention nicht als scharfe Gegensätze, sondern als sich ergänzende Aussagen zu begreifen sind. Im Ergebnis ist damit der Spielraum für eine punitive Strategie, die sich objektiver Strafbarkeitsbedingungen bedient, stark eingeschränkt. Im Rahmen der Untersuchung wird eine Kontrollformel erarbeitet, die bei der Unterscheidung von zulässigen und unzulässigen objektiven Strafbarkeitsbedingungen Orientierung gibt; außerdem erfolgt eine Abschichtung zu den Prozeßvoraussetzungen.Im 'Besonderen Teil' werden nach Maßgabe der zuvor entwickelten Kriterien die Strafbestimmungen, die nach herkömmlicher Anschauung objektive Strafbarkeitsbedingungen enthalten, eingehender Prüfung unterzogen. Dem Bestreben, die objektiven Strafbarkeitsbedingungen in ihrem Verhältnis zueinander näher zu analysieren, dient ein sich anschließender Systematisierungsversuch.
