Hierbei wird der Angeklagte mit entsprechender Kostenfolge schuldig gesprochen, aber keine weitere Sanktion verhängt. Die zahlreichen Vorschriften…, in denen diese ungewà hnliche Rechtsfolge vorgesehen ist, sind über den Allgemeinen und Besonderen Teil des Strafgesetzbuchs verstreut. Wohl auch deshalb ist die praktische Bedeutung dieses Rechtsinstituts beschränkt. Bislang fehlte eine umfassende Untersuchung und Systematisierung der Grundgedanken, die das Absehen von Strafe in auÃergewà hnlichen Fällen rechtfertigen. Dem widmet sich diese Arbeit, die mit konkreten Vorschlägen für die Gesetzgebung schlieÃt. Zunächst wird hierfür das Absehen von Strafe zu ähnlichen Erscheinungen abgegrenzt. Die folgende Untersuchung der vielen Vorschriften, die im Strafgesetzbuch das Absehen von Strafe vorsehen, zeigt übereinstimmende Gesichtspunkte, die sich systematisieren lassen. Die Systembildung setzt beim Sinn und Zweck des Rechtsinstituts an. Von Strafe abgesehen werden kann demnach, wenn alleine dadurch allen Strafzwecken Rechnung getragen wird. In bestimmten Ausnahmefällen sind Unrecht oder Schuld oder beides trotz des VerstoÃes gegen ein Strafgesetz derart gemindert, dass die Rechtsgemeinschaft hierfür den eher symbolischen Akt des à ffentlichen Schuldspruchs hinnimmt. Dies geschieht nicht nur, wenn die Folgen der Tat ausnahmsweise für den Täter so schwer sind, dass er "bestraft genug" erscheint, sondern auch, um Täter durch die Privilegierung von tätiger Reue, Wiedergutmachung oder von Aufklärungs- und Präventionshilfe zum Rechtsgüterschutz zu motivieren. Hinzu treten auÃergewà hnliche Fälle besonders geringer Normverletzung, bei denen zur Wahrung der Strafzwecke keine weiteren Sanktionen notwendig sind. Da diese Grundgedanken allgemeine Geltung für eine Vielzahl von Vorschriften haben, bietet sich die Ersetzung der unübersichtlich vielen Einzelnormen durch wenige allgemeine Regeln an. Deshalb endet die Arbeit mit einem Gesetzgebungsvorschlag, der dem Absehen von Strafe zu grà Ãerer praktischer Bedeutung verhelfen will.
