In den freisinnigen Kantonen erging der Ruf nach Überordnung des Staates über die Kirche. Zu diesem Zweck vereinbarten Bern, Luzern, Solothurn, Baselland, Aargau, Thurgau und St. Gallen 1834 unter sich die 14 sog. ?Badener Artikel?, denen zufolge nun auch der Aargau das staatliche Plazet [.] einführte, den Klöstern Muri, Wettingen, Fahr, Hermetswil, Gnadental und Baden die Selbstverwaltung entzog und sie unter die Administration des Staates stellte. Muri 1991, pp. 132-135). - "Im Geist der Helvetik (1798) und der Badener Artikel (1834) stellte der Grosse Rat 1835 die Klöster vollständig unter staatliche Verwaltung [.]. Für die in der liberalen Verfassung von 1831 vorgeschriebene Verfassungsrevision nach zehn Jahren verlangten die konservativen Katholiken (Bünzer Komitee 1839) v.a. die Beibehaltung der Parität und (in Kirchen- und Schulfragen) konfessionell getrennt tagende Grossratskollegien. Die liberal-radikalen Kräfte hingegen erstrebten eine Vereinheitlichung und die völlige Integration der Minderheiten in den Staat. Ein erster Verfassungsentwurf wurde 1840 [.] von radikaler wie von konservativer Seite wuchtig abgelehnt. Nachdem der Gr. Rat den Grundsatz der Parität für die Legislative gestrichen hatte, wurde die revidierte Verfassung am 5. Jan. 1841 vom Volk mit 58% angenommen. Um allfälligen Unruhen vorzubeugen, liess die Regierung das Bünzer Komitee verhaften. Die dadurch erst recht aufgebrachten konservativen Freiämter Katholiken boten den Landsturm auf, wurden jedoch von Regierungstruppen bei Villmergen geschlagen. An der Sitzung des Gr. Rats vom 13.1.1841 forderte der radikale Katholik Augustin Keller in einer programmatischen Rede die Aufhebung aller aargauischen Klöster wegen Fortschrittsfeindlichkeit und Aufruhr. Dem Antrag wurde [.] zugestimmt. Vom Beschluss waren acht Klöster [.] betroffen. [.] Die eidg. Tagsatzung erklärte den Aufhebungsbeschluss jedoch als unvereinbar mit dem Bundesvertrag von 1815 [.]. Nach langen Auseinandersetzungen stimmte der aargauische Gr. Rat der Wiederherstellung der vier Frauenklöster zu, worauf die konfessionell nicht minder gespaltene Tagsatzung am 31.8.1843 mit zwölf und zwei halben Stimmen die Klosterfrage für erledigt erklärte. Wintermonat [Dezember] 1838. (4 SS.) ? Erste Zivilprozessordnung des autonomen eidgenössischen Standes Aargau (vgl. Barth 3, pp. 72 ff., u. Nr. 25097). Vor 1803, d.h. vor der Mediation, ganz besonders aber vor Beginn der Helvetik 1798 waren die staatlichen und damit auch die rechtlichen Verhältnisse vielschichtig und kompliziert, dabei in vielerlei Hinsicht von Bern abhängig und geprägt (vgl. dazu HBLS unter ?Aargau?). Den allgemeinen Bestrebungen in der Zeit nach 1815 folgend, wurde auch hier eine Vereinheitlichung der Gesetzgebung an die Hand genommen ?und bereits 1826 mit dem Entwurf eines Personenrechts ein Anfang zur Kodifikation gemacht [.], der dann aber zunächst nicht weiter verfolgt wurde? Offenbar absorbierten die politischen Ereignisse und Wirren der Jahre vor dem Sonderbund, in denen dem Aargau z.B. durch die Klosteraufhebungen eine gewisse Vorreiterrolle zukam, aber auch die virulenten Auseinandersetzungen um die neue Verfassung (um 1831, vgl. HBLS 1, p. 28) so viel Energien, dass die Kodifikation erst 1848 wieder aufgenommen werden konnte. In ?den Jahren 1848 bis 1856 wurde alsdann [.] das ganze bürgerliche Gesetzbuch ausgearbeitet und in Kraft gesetzt? (Huber loc. cit.).
