Der Autor und frühere Bundesbeauftragte für den Datenschutz liefert eine eingehende Kritik des geltenden Datenschutzrechts: Der Gesetzgeber und die Kontrollinstanzen haben manche Risiken der Informationstechnik für die…Individualrechte überbewertet und das entgegenstehende Interesse an freier Kommunikation vernachlässigt. So sind nicht nur Wertungswidersprüche entstanden, sondern das Datenschutzrecht hat insgesamt den Charakter einer bürokratischen Überregulierung angenommen. Der unverzichtbare Schutz von Privatheit und Persönlichkeitsrecht muss anders als bisher gestaltet werden. Nicht alle denkbaren Informationsvorgänge müssen gesetzlich geregelt werden; das in Deutschland geltende »Verbot mit Erlaubnisvorbehalt« ist unangemessen. Es gibt alternative Ansätze, die den Problemen besser gerecht werden. Überdies sind manche Erwartungen unerfüllbar. Das Menschenrecht auf Privatsphäre ist zwar weltweit anerkannt, es kann aber nicht die übermäßige Kommerzialisierung aller Lebensvorgänge verhindern oder die wirtschaftliche Macht der großen Internetkonzerne einschränken. Datenschutz ist auch kein geeignetes Instrument, um die von manchen befürchtete Herrschaft der Maschinen über die Menschen zu verhindern; hier sind andere Methoden nötig, um die Nutzung neuer Techniken verantwortlich zu gestalten.
