Die Ausübung derartiger Aufgaben behält Art. 33 IV GG im Regelfall Beamten vor. Die Reichweite dieser Verfassungsbestimmung ist seit langem umstritten. Die Autoren untersuchen in der vorliegenden Studie zunächst eingehend das Tätigkeitsfeld der öffentlich-rechtlichen Sozialversicherungsträger, insbesondere der gesetzlichen Arbeitslosen-, Kranken-, Pflege-, Renten- und Unfallversicherung. Bei der Anwendung des Art. 33 IV GG wird hier eine generalisierende Zuordnung ganzer Verwaltungsbereiche abgelehnt und demgegenüber differenzierend überprüft, ob und inwieweit die einzelnen Dienstposten mit der Ausübung hoheitsrechtlicher Befugnisse betraut sind. Dabei zeigt sich, daß ein Großteil der Bediensteten hoheitsrechtliche Befugnisse ausübt und daher verbeamtet werden muß. Wenngleich diese Fragen bisher nicht unmittelbar durch höchstrichterliche Rechtsprechung eindeutig entschieden sind, so sprechen doch die bisherigen Stellungnahmen sowohl des BVerfG als auch des BVerwG, des BGH und des BAG für die hier vertretene Sicht von Art. 33 IV GG. Diesen Anforderungen genügt es auch nicht, wenn Angestellte durch - in der Sache dem Beamtenverhältnis stark angenäherte - Dienstordnungsangestellte ersetzt werden. In jüngerer Zeit ist der gegenläufige Trend erkennbar, die Ersetzung von Dienstordnungsangestellten durch Tarifangestellte; entgegen vereinzelt vertretener Auffassungen in der Literatur entfernt sich diese Praxis noch weiter von der verfassungsrechtlich gebotenen Gestaltung und stellt daher einen (weiteren) Verstoß gegen Art. 33 IV dar.
