Public law governs the relationship between individuals and the states whereas private law regulates the relationship between individuals.When it comes to the laws ruling the aviation world, we also have to divide into these two parts: the public international air law represented in general by the Chicago Convention (formally 'The Convention on International Civil Aviation' done at Chicago on 7 December 1944) and on the other side the private international air law, mainly represented through the Montreal Convention (formally 'Convention for the Unification of Certain Rules for the International Carriage by Air'). The latter represents the liability law in international air transport, regulating the relationship between an air carrier and its customer, passenger, consignor or cargo shipper. It is supposed to replace the Warsaw Convention of 1929 which sets compensation levels for victims of air accidents, as well as liability for damage, delay or loss of baggage and cargo.This paper describes first the historical way the Convention developed from Warsaw to Montreal and then goes into detail of the Montreal Convention with its achievements and deficiencies. This new regulation allows airport operators to continue with providing apron management service - but they have to 'declare their capability' for offering this service within the certification process of the aerodrome.An advanced surface movement guidance and control system is one important tool for providing this service at large and complex airports. With the implementation of an advanced surface movement guidance and control system (A-SMGCS), the airport contributes to the precise surface guidance of aircraft to and from a runway while maintaining safe distance to each other as well as to obstacles and vehicles. The system is aimed to assist the ground controllers in managing the traffic situation on the movement area in all weather conditions. Due to advanced surveillance technology, the ground movement controllers are able to continue operations with an A-SMGCS even in low visibility conditions (e.g. due to fog) and maintaining nearly the same capacity as with no visibility restrictions.The focus of this master thesis is not on the operational and technical details of the system, which are profoundly analyzed and elaborated on by R&D projects, e.g. by the German Aerospace Center (DLR), European research projects and the industry. However, the second chapter will provide those details required to fully understand the legal and administrative aspects of an A-SMGCS.If ANSP are using a system like A- SMGCS under safety aspects, they have to undergo a licensing process according to SES-regulations and are licenced by the national supervisory authority. The airport itself is licenced by the appropriate approving authority of the federal state. For Germany's biggest airport, Frankfurt International Airport, it's the ministry of transport of Hesse, the HMWVL. This ministry licences the airport as such as well as the safe provision of apron management service including the use of procedures and technical systems like A-SMGCS.The conditions for this approval are subject of the Master's Thesis.

Nach Charles Moskos ist anhand der amerikanischen und westeuropäischen Geschichte zwischen drei Epochen militärischer Organisation zu unterscheiden:1Die erste Epoche (bezeichnet als 'Modern Type') reicht von 1648 bis zum Ende des Zweiten Weltkrieges. Zu dieser Zeit herrschte ein ausgeprägtes Nationalstaatsdenken und das Streben nach nationaler Souveränität stand in der Politik aller Staaten an oberster Stelle. Militärisch interessant ist die 1793 erstmals in Europa auftretende radikale Bürgerbewegung 'levee en masse' während der französischen Revolution.Die Zeit nach dem Zweiten Weltkrieg bis zur deutschen Wiedervereinigung, geprägt durch den Kalten Krieg, wird von Moskos als 'Late Modern Type' bezeichnet. Schlagworte dieser Epoche sind Antagonismus, Bipolarismus, Nuklearzeitalter, Abschreckungspolitik und Abschottung. Die Massenverpflichtungen zum Militärdienst führten zum Höhepunkt der allgemeinen Wehrpflicht in der deutschen Bundeswehr, die vor allem in der Offiziersausbildung die Betonung auf die Professionalität der Ausbildung (vgl. auch Einführung des Studiums in die Offizierslaufbahn) legte. Gesellschaftspolitisch stand die Angst vor der totalen Vernichtung in der westlichen und östlichen Welt im Vordergrund (vgl. 1962 Kuba Krise), weswegen die Macht der Bevölkerungsvernichtung als herausragendstes Merkmal des Kalten Krieges gesehen wird.Mit der deutschen Wiedervereinigung 1990 und dem Zusammenbruch der UdSSR und des Kommunismus' fiel die akute Bedrohung für die westlichen Staaten weg. Höhepunkte dieser interalliierten Kriegskonferenzen waren zweifelsohne die beiden einzigen Konferenzen aller drei Regierungsspitzen in Teheran und Jalta, wo sich Roosevelts Konzept über den Umgang mit der Sowjetunion verdeutlichen läßt. Sehr hilfreich bei dieser Analyse sind die umfangreichen Memoiren des britischen Premierministers Churchill, die Studie von Günter Moltmann über 'Amerikas Deutschlandpolitik im zweiten Weltkrieg' sowie der Wegweiser durch die alliierten Kriegskonferenzen von Gerd Ressing mit dem provokativen Titel 'Versagte der Westen in Jalta und Potsdam '.Nach dem Tode F.D. Roosevelts kam Harry Spencer Truman an die Macht, die amerikanisch-sowjetischen Beziehungen verschlechterten sich und in den USA war eine Abkehr von der Kooperationspolitik erkennbar. Doch was waren die Ursachen für diesen Wandel in der amerikanischen Politik Zur Beantwortung dieser Fragen sind die Memoiren von Harry Truman und die seines stellvertretenden Botschafters in Moskau, George F. Kennan, lesenswert und auch die beiden Studien des habilitierten deutschen Politikwissenschaftlers Ernst-Otto Czempiel 'Weltpolitik der USA nach 1945, Einführung und Dokumente' sowie 'Das amerikanische Sicherheitssystem 1945-1949, Studie zur Außenpolitik der bürgerlichen Gesellschaft' sind ebenfalls sehr hilfreich. Nachdem die Berichte der ideologischen Vorreiter (George Kennan und James Byrnes) erläutert worden sind, wird der Anlaß und der Inhalt der Truman-Doktrin skizziert und die Frage beantwortet, was denn so besonderes an der Doktrin war, daß die USA durch sie einen neuen Kurs eingeschlagen haben.Der Schwerpunkt dieser Seminararbeit liegt in der Herausstellung des Unterschiedes zwischen der Politik Roosevelts und Trumans in Bezug auf die Sowjetunion sowie in der Beschreibung der Vorgeschichte und der Erläuterung des Inhaltes der Doktrin.

Der dominante Einfluss des französischen Rechtskreises auf die Geburt des Gerichtshofes wird besonders bei der Einrichtung der Institution des Generalanwaltes deutlich, dessen Entwicklung vom Ursprung bis zum gegenwärtigen Stand der Dinge nachgezeichnet wird. Im Sinne eines systematischen Aufbaus ist es unerlässlich, die Quellen des Gemeinschaftsrechts zu erforschen, bevor im zweiten Kapitel die unterschiedlichen Verfahrensarten vor dem EuGH erörtert werden. Nach einem Exkurs über die Sprachenregelung am Gerichtshof, die in naher Zukunft babylonische Ausmaße anzunehmen scheint, schließen sich die Ausführungen zum Generalanwalt, dem Untersuchungsgegenstand dieser Diplomarbeit, an. Seine Rechtsstellung, Aufgaben, Befugnisse und Funktionen werden im dritten Kapitel umfassend beleuchtet und Abgrenzungen zu den europäischen Richtern, denen die Generalanwälte zuarbeiten, vorgenommen. Die dem Generalanwalt obliegende Amtspflicht, das Verfassen und Vortragen der Schlussanträge, wird ausführlich im vierten Kapitel beschrieben. Sodann werden die Schlussanträge den ergangenen Urteilen gegenübergestellt. Die verschiedenen Methoden der Rechtsauslegung erläutert das Ende des vierten Kapitels, unter besonderer Berücksichtigung der für das Europarecht spezifischen finalen Auslegungsmethode. Ein ausführlicher Vergleich zwischen allen Urteilen des Jahres 2001 und den dazugehörigen Schlussanträgen findet sich im Anhang der Diplomarbeit.
