This book contributes to the field by interpreting H.L.A. Hart's internal poin…t of view as a set of empirical hypothesis and evaluates them in light of findings in experimental behavioral economics. Additionally, it presents a new experiment with a specific jurisprudential aim. The results are then compared to other empirical methodologies.; Rechtsphilosophie und Empirie sind sich traditionell fremd und ein Großteil der Rechtsphilosophie arbeitet konzeptuell und hermeneutisch. Zwar werden naturalistische Ansätze ab und zu vertreten, diese dringen aber typischerweise nicht zu tatsächlich empirischer Forschung vor. Diese Arbeit leistet einen Beitrag zur neuen Strömung der experimentellen Rechtsphilosophie, indem sie ein zentrales Konzept des wegweisenden Rechtsphilosophen H. L. A. Hart empirisch untersucht. Als Anknüpfungspunkt wird Harts Teilnehmerperspektive gewählt, welche als zentrale methodische und inhaltliche Weichenstellung der Rechtsphilosophie des 20. Jahrhunderts gilt. Zunächst begründet die Arbeit, warum die Teilnehmerperspektive als empirische Hypothese begründet werden kann. Dann überprüft sie den deskriptiven Gehalt der These anhand der Erkenntnisse experimenteller Verhaltensökonomie. Schließlich liefert sie einen eigenen experimentellen Beitrag mit rechtsphilosophischem Erkenntnisinteresse. In einem Ausblick werden die Ergebnisse mit anderen empirischen Methoden abgeglichen.; Dissertationsschrift.
