The disclaimer opposite the copyright page notes "There is always an element of risk in standing up for one's lawful rights in the face of an oppressive taxing authority backed by a biased judiciary. Therefore, the author and publisher disclaim any responsibility for any liability or loss incurred as a consequence of the use or application . . . of any advice or information presented herein." Schiff, a libertarian and one of the best known tax resistance advocates, was twice convicted of tax evasion and sentenced to prison. During his second term, in October of 2015, he died in federal prison at the age of 87 of cancer. INSCRIBED on the front endpaper. Reading list. 176 pp. Very good overall in red cloth with gilt lettering - previous owner's name on front pastedown, marginal check marks, brackets and some underlining throughout, most in pencil - in a good only dust jacket with some soiling, minor edgewear and a few spots of dampstaining on the back cover. Uncommon in the first edition, and especially so signed. .

Whether or not it's pragmatically wise to follow his advice, Schiff's historical research into the purposely confusing federal tax code and law (the code is not "law") -- and his insistence that as per the Brushaber and Eisner Supreme Court rulings the 16th amendment did not repeal the constitutional requirement that any federal tax must be collected either as a direct tax (divided among the states and then assessed by capitation) or else an indirect excise -- is intriguing. The federal response -- that the federal income tax is "neither kind of tax" and can thus be collected by means not legal for either kind of constitutional tax -- seems to come down to "because we say so and we've got the guns and the badges." In October of 2015, Irwin Schiff died in federal prison at the age of 87, of a cancer contracted there and not optimally treated, having been jailed for exercising his First Amendment rights on this subject, without ever being allowed by the federal courts to substantially present his findings to a jury -- citing chapter and verse of their own law and the relevant Supreme Court rulings -- or to confront and cross-examine agents of the Treasury, the "IRS" or the Social Security Administration (his accusers) at length on their claims for the lawfulness and constitutionality of their current collection and enforcement regimes, since of course such a defendant can't be allowed to present a substantive defense over the course of several days, lest the courtroom be "turned into a circus" -- a week of the judge's handsomely compensated time being far more valuable than 20 years of the defendant's. (This is typical of the behavior of today's federal judges, by the way. They so limit the facts and defenses which they will "allow" defense attorneys to present -- especially the constitutionality of the "law" in question -- that the case is largely over before it begins.) 305 pp. Signed copies are uncommon.
