Es sabido que las penas accesorias reguladas escuetamente en la Sección 5ª del Capítulo I, Titulo III, Libro I (arts. 54 al 57), ya sea en una u otra modalidad están presentes en todos los fallos condenatorios. Sin embargo, hasta el presente nunca han sido objeto de un tratamiento monográfi co que analice su fundamento, sus fi nalidades, y lo que es más importante, su compatibilidad, con el resto de las categorías descritas en el Libro I del Código penal, y, en defi nitiva, con los principios fundamentales que deben inspirar la interpretación y aplicación de las penas. Al contrario, aunque también son castigos, siempre han sido tratadas con desinterés, siendo comúnmente percibidas como simples apéndices de la condena. Sin embargo, como se apunta con detalle a lo largo del texto, dejando por el momento de lado otros atributos también muy cuestionables, hay importantes contenidos constitucionales, sin ir más lejos del principio de legalidad, que están en juego en la aplicación de las accesorias. De ahí que con la publicación del libro "De las penas accesorias a las penas complementarias. La descripción de un proceso legislativo inacabado" se ambicionen varios objetivos: visibilizar esta clase de penas, para arrancarlas del limbo histórico donde parece que prácticos y teóricos coinciden en seguir confinándolas, intentar dar respuesta a cuantos problemas ha ido sugiriendo la práctica, cuestionado su aplicación en muchas ocasiones por ambigua, otraspor ser claramente contradictoria y frecuentemente extensiva en sus efectos. Y, por último, apuntar algunas pautas para la deseable reforma del régimen de la accesoriedad, y de este modo aproximarlas a otros modelos comparados, donde desempeñan el papel de auténticas penas complementarias y a veces el de penas alternativas a la de prisión.
