Die Exekutive…hat dagegen die Aufgabe, die von der Legislative erlassenen Normen umzusetzen. Dies entspricht dem Grundsatz der Gewaltenteilung, der in der deutschen Rechtsordnung verfassungsrechtlich verankert ist.Da die Europäische Union (noch) keine Staatsqualität besitzt, verfügt sie über keine Gewaltenteilung im klassischen Sinn. In den EU-Verträgen werden die drei Gewalten Legislative, Exekutive und Judikative nicht ausdrücklich aufgeführt oder unterschieden. Um einer Machtkonzentration einzelner Institutionen entgegenzuwirken, hat sich für die unionsrechtliche Form der Gewaltenteilung der Begriff des institutionellen Gleichgewichts konstituiert. Der Union liegt ein dem rechtsstaatlichen Gewaltenteilungsprinzip ähnelndes Prinzip der Funktionenteilung zugrunde, welches Aufgabenverschiebungen zwischen den Organen verhindern und die ausbalancierte Kompetenzordnung gewährleisten soll.Von diesem Gewaltenteilungsschema sind beide Rechtsordnungen in der Praxis bedeutend abgewichen. Es ist illusorisch, die Vielgestaltigkeit und Dynamik der Wirklichkeit in Gesetzen einzufangen. Denn je detaillierter gesetzliche Regelungen ausfallen, desto höher ist das Risiko, dass sich die an der Gesetzgebung beteiligten Akteure nicht einigen können. Normen werden daher in zunehmendem Ausmaß nicht auf dem traditionellen Weg der parlamentarischen Gesetzgebung durch die eigentlichen Gesetzgebungsorgane in Form von Gesetzen, sondern durch die Exekutive in Form von Rechtsverordnungen erlassen.Eine solche Umverteilung der Kompetenzen widerspricht in ihrem Kern der Idee der Gewaltenteilung, da die Exekutive Aufgaben wahrnimmt, die dem Kompetenzbereich der Legislative zufällt. Die deutsche Rechtsordnung erkennt diese 'Durchbrechung' des Gewaltenteilungsgrundsatzes und die damit verbundene rechtsetzende Ermächtigung der Exekutive jedoch als Notwendigkeit einer optimierenden Funktionenordnung an. Der Befugnis der Exekutive zur Rechtsetzung wird in beiden Rechtsordnungen durch die Verankerung von Ermächtigungsnormen - Art. 80 GG und Art. 290, 291 AEUV - Gültigkeit verliehen.Die ungleichartige Ausgestaltung der exekutiven Rechtsetzung in Deutschland und der Europäischen Union näher zu beleuchten, ist mit Blick auf die gesetzlichen Neuerungen seit Inkrafttreten des Lissabon-Vertrags das Ziel der Arbeit.
