Results on questionnaires revealed the problems related to ADR methods used by construction industry and at the said Act. Further,it presented potential solutions to overcome those problems.Additionally, recommendations to the part IX of the Act granted by interviews.Through these results,legal framework for an effective implementation of ADR methods under the Act was developed. By practicing this framework, the projects can be continued without deadlock, whenever dispute has arisen. 80 pp. Englisch.

Daher konzentriert sich diese Studie auf die Entwicklung eines rechtlichen Rahmens für eine effektive Umsetzung von ADR-Methoden zur Beilegung von Streitigkeiten in der srilankischen Bauindustrie. Die Untersuchung wurde mit einer Literaturrecherche eingeleitet und mit einem Umfrageverfahren durchgeführt, bei dem in zwei Runden Fragebögen verteilt und halbstrukturierte Interviews mit Baufachleuten mit mehr als zehn Jahren Erfahrung geführt wurden. Die Ergebnisse der Fragebögen zeigten die Probleme im Zusammenhang mit ADR-Methoden, die in der Bauindustrie und im besagten Gesetz verwendet werden. Daher konzentriert sich diese Studie auf die Entwicklung eines rechtlichen Rahmens für eine effektive Umsetzung von ADR-Methoden zur Beilegung von Streitigkeiten in der srilankischen Bauindustrie. Die Untersuchung wurde mit einer Literaturrecherche eingeleitet und mit einem Umfrageverfahren durchgeführt, bei dem in zwei Runden Fragebögen verteilt und halbstrukturierte Interviews mit Baufachleuten mit mehr als zehn Jahren Erfahrung geführt wurden. Die Ergebnisse der Fragebögen zeigten die Probleme im Zusammenhang mit ADR-Methoden, die in der Bauindustrie und im besagten Gesetz verwendet werden. Darüber hinaus wurden mögliche Lösungen zur Überwindung dieser Probleme aufgezeigt und Empfehlungen zu Teil IX des Gesetzes ausgesprochen, die durch die Interviews bestätigt wurden. Durch die Anwendung dieses Rahmens können die Projekte ohne Stillstand fortgesetzt werden, wenn es zu Streitigkeiten kommt.

Além disso, foram feitas recomendações para a parte IX da lei, que foram concedidas através de entrevistas.
