Zuerst we…rden die allgemeinen Grundlagen gelegt, wenn zum einen das System der Zweispurigkeit in seiner Bedeutung und zum anderen das Verbot der reformatio in peius in seinem Inhalt und insbesondere seiner rechtsstaatlichen Herleitung dargestellt wird. Einen wichtigen Abschnitt bildet der Komplex, in dem der Begriff 'Nachteil' untersucht wird. Im Ergebnis zeigt sich der Vorzug einer generell-objektiven Betrachtungsweise. Eine erste Verzahnung der beiden Begrifflichkeiten 'Verschlechterungsverbot' und 'Maßregeln' erfolgt in dem Teil der Arbeit, der sich mit dem Verbot in den verschiedenen Verfahrenskonstellationen beschäftigt, in denen Maßregeln angeordnet werden können. Hier zeigt sich ein überaus weiter Anwendungsbereich des strafprozessualen Verschlechterungsverbots.Im zweiten Teil der Arbeit verknüpft Joachim Kretschmer die beiden Rechtsinstitute im einzelnen. Das Verbot der reformatio in peius wird - bezogen auf jede einzelne der sechs strafrechtlichen Maßregeln des61 StGB - umfassend dargestellt. Hierbei behandelt der Autor beispielsweise folgende Rechtsprobleme: Das Verhältnis der Maßregeln der Besserung und Sicherung und ihre Austauschbarkeit untereinander, das Verhältnis der Maßregeln zu den Strafen, die Ausnahmeregelung in den331 Abs. 2, 358 Abs. 2 Satz 2 und 373 Abs. 2 Satz 2 StPO und ihre Unvereinbarkeit mit dem rechtsstaatlichen Verbot, den Einfluß einer vorläufigen Entziehung der Fahrerlaubnis auf die Festsetzung der Sperrfrist.Nach einer ausführlichen Untersuchung ergibt sich als wesentliches Ergebnis, daß die Maßregeln im Rahmen des Verschlechterungsverbots unvergleichbar und daher auch unaustauschbar sind. Die Maßregeln dürfen in einem Rechtsmittelverfahren unter der Geltung des Verbots weder nachträglich angeordnet noch miteinander ausgewechselt werden.
