With the emergence of globalization starting in the last century it became evident that there is a need to approximate the existing rules to foster international trade. In theory, this should allow all participating actors to benefit more than ever leading in the long run to greater wealth for everyone. In 1980, 42 countries agreed on the CISG to address hindrances to the growing international trade by adopting a default uniform international framework for the sales of goods. The preamble specifies that 'the adoption of uniform rules which govern contracts for the international sale of goods and take into account the different social, economic and legal systems would contribute to the removal of legal barriers in international trade and promote the development of international trade'. At the time of writing, the CISG has been in force for 27 years and it is time to evaluate whether the goals the drafters had in mind have been achieved. In order to assess the successfulness of the CISG to promote a unified international sales law a multitude of factors can be taken into account. To not unduly exceed the limits of this paper the author determined three key criteria on whose basis the successfulness will be evaluated. Firstly, the acceptance of the CISG in the international community will be evaluated. Secondly, the influence of the CISG on subsequent international, regional and domestic legislation and initiatives relating to sales and contract law will be addressed. Lastly, after determining the scope of application the paper focuses on the CISG's capacity to safeguard and foster its uniform application.

The Intergovernmental Panel on Climate Change observed in his 'Fourth Assessment Report on Climate Change' in 2007 that within the period of 1906 to 2005 the climate changed significantly. Global warming, increasing precipitation and a sea-level rise are just some indicators supporting the findings. One of the major causes leading to climate change is the increasing carbon dioxide concentration in the air mainly due to the use of fossil fuels.The International Energy Agency outlined that with the lack of new energy sources or at least changed energy policies, the energy-related CO2 emissions in 2050 will be twice the level of 2007. Therefore, politicians and scientists all over the world are making a huge effort to develop and provide measures for reducing the emissions of CO2 and other global warming gases. Besides the more famous accomplishments such as the subsidization of renewable energy sources or emission trading a new technology emerged in the past decade, Carbon Capture and Storage (CCS).It can be described, in general, as a technique to reduce CO2 emissions into the atmosphere by sequestrating it from fossil fuels and storing it into geological formations in the ground or in the sub-seabed. In chapter 'B' this paper will give an overview about the technological concept of CCS and the various approaches that are currently examined by scientists.CCS is seen as one of the most feasible climate change mitigation options due to its capability to reduce the emission of CO2 into the atmosphere without abandoning the use of fossil fuels. To do justice to this rating, it is necessary to support the deployment of CCS by developing and constructing legal frameworks and regulations that are flexible enough to allow for new technological advancements. The European Union is taking a big step forward with its Directive 2009/31/EC of the European Parliament and of the Council by creating a regulatory framework for the geological storage of CO2.

Due to the fact that there is no possibility for a community to own land or to hold fee simple estates in land, English Law has developed limited access 'communal property rights'. These rights can be exercised over areas known as commons.Commons have their origin in the agricultural tradition that has been established in the late 11th century to use the harvested fields together for common grazing of the animals of all members of a locality. Out of these local customs evolved the so called 'rights of common' as part of the communal property rights. They are held by distinct individuals of a community and include rights such as fishing, grazing or to collect firewood which can be asserted by them.Over time, the use of particular rights of common decreased due to the industrialization. The changing reliance of the people on certain resources such as timber and the second communal property rights called customary rights of fluctuating bodies gained in importance. They can only be acquired by custom or by long use and have the peculiarity that they can be exercised, once they have been established, by anybody independently of ownership as long as he belongs to the particular local community.One of the most frequently exercised customary rights is the right of recreational use on which this paper puts the focus on. This use has been very limited in the history of English law, but in the 13th century some land has been increasingly used by the local inhabitants for recreation or sports and the courts started to declare a land as town or village green with protection from interference if a long term use could be verified.Since the 19th century the centre of gravity shifted from the agricultural benefits of town or village greens to the recognition of the large general public interest in recreation and the countryside. This development culminates after various other statutory provisions in favor of the protection of town or village greens in the Commons Registration Act in 1965.

As a logical conclusion of this long term development, it is obvious that the issue of harmonization includes a broad variety of difficult legal aspects that has been and will be examined by a large number of lawyers and courts. This paper will put the focus on maximum harmonization by directives itselves. But what is meant by the term maximum harmonization In order to answer this question, there will be given a short overview of the general idea behind harmonization. Furthermore, the paper will provide an introduction to the theoretical concept of maximum harmonization. As one might observe during the analysis of the first part, the bulk of the problems arise around the relationship between the competences of the European legislator and the different national legislators. The pivotal question of this work therefore is: 'How much leeway is left to the Member States of the European Union by implementing a European maximum harmonizing directive into the national legal order in case of doubt 'The research will be rooted in the field of unfair competition law and in particular with comparative advertising, which is currently a highly controversial field regarding the aspects of harmonization due to the fact that there is a multiplicity of regulatory approaches in the Member States. 2To point out the cruxes of the question with reference to the chosen field of law and to illustrate the concept of maximum harmonization, a relatively recent case between O2 Holdings Ltd. and Hutchison 3G UK Limited3 will serve as object of investigation. In the end, there will be some final remarks on the topic of harmonization in the European Union in general.

In order to support the importance of official statistics, the Federal Constitutional Court of Germany stated in its decision on the census of population that official statistics are an indispensable basis for a welfare state. All this also applies to the official criminal statistics. Governments, for example, use them to improve the performance of their own criminal justice system to achieve a safer environment for their citizens . The public is interested in the data to find out about the crime risks in their neighborhood and how the authorities are dealing with it. Criminal statistics are frequently used by politicians or in the mass media to substantiate an allegation without challenging the data. By doing this, it is assumed that the statistics are infallible and present a full image of the extent of crime This point, however, has to be critically judged, since official statistics seem to be 'both partial and subjectively constructed' . In this paper, I will outline the positive and negative aspects of official criminal statistics. Moreover, I will discuss, if they have the ability to represent the full extent of crime or not.

As a result, the amount offoreign direct investment expanded faster than the world economy and the volume of international traderesulting in a need to control the investment flows and to regulate the area.1By virtue of the rather sensitive topic of foreign direct investments, it was impossible in the past for theinternational community to agree upon an uniform and harmonized international regime setting out thestandards for international investments. Hence, a multitude of national and international policy rules andprinciples govern the relevant aspects in this field resulting in a variety of international investmentagreements. As an example, more than 2670 bilateral investment treaties and more than 270 otherinternational investment agreements have been adopted globally until the end of 2008.2Nevertheless, the plurality of the different international investment agreements with their different scopes,different types, different signatories have led to a patchwork of treaties resulting in a highly fragmentedand incoherent international investment regime. As proposed in the Lisbon and Gothenburg in 2000 and 2001, the European Union wants to be the most competitive and dynamic knowledge-based economy with a sustainable growth, more social cohesion as well as respect for the environment. One of the opportunities to achieve this objective is bioenergy, or in particular biofuels, which may allow for the reduction of greenhouse gas emissions, more energy security as well as the promotion of sustainable development globally and the creation of new markets. Biofuels can be defined as solid, liquid or gas fuel consisting of, or derived from biomass, which is composed of living and recently dead biological material. The best-known products are bioethanol and biodiesel, which are first generation biofuels derived from renewable resources, in particular food crops. Second generation biofuels, e.g. lignocellulosic biomass, vary in the fact that they are manufactured from non-food crops.To use this opportunity, the European Union crowned its preceding efforts with respect to renewable energy sources like biofuels with the release of the ambitious climate and energy policy package in January 2008. It contained various proposals for Directives including binding targets for greenhouse gas reductions, energy savings and the share of renewable energy in the total energy consumption. As a result of the long-term policy support covered by the European Union, the biofuels production has increased rigorously.

The International Energy Agency outlined that with the lack of new energy sources or at least changed energy policies, the energy-related CO2 emissions in 2050 will be twice the level of 2007. Therefore, politicians and scientists all over the world are making a huge effort to develop and provide measures for reducing the emissions of CO2 and other global warming gases. Besides the more famous accomplishments such as the subsidization of renewable energy sources or emission trading a new technology emerged in the past decade, Carbon Capture and Storage (CCS). It can be described, in general, as a technique to reduce CO2 emissions into the atmosphere by sequestrating it from fossil fuels and storing it into geological formations in the ground or in the sub-seabed. In chapter ¿B¿ this paper will give an overview about the technological concept of CCS and the various approaches that are currently examined by scientists. CCS is seen as one of the most feasible climate change mitigation options due to its capability to reduce the emission of CO2 into the atmosphere without abandoning the use of fossil fuels. To do justice to this rating, it is necessary to support the deployment of CCS by developing and constructing legal frameworks and regulations that are flexible enough to allow for new technological advancements. The European Union is taking a big step forward with its Directive 2009/31/EC of the European Parliament and of the Council by creating a regulatory framework for the geological storage of CO2.
