Taking over from the role of feudal and communal courts of the Middle Ages, the office of Justice of the Peace became fundamental to local governance in early modern England. 'In spite of striking changes social, political, economic, and governmental the importance of the Justices of the Peace has been inevitable and omnipresent' (Skyrme). 'By the time of the Tudors, the English system of local government rested solidly on the social control wielded by the justice of the peace. The men chosen from the local gentry to fill the position were seldom trained in law. Since they were given wide discretion in the performance of their duties, they often required some form of guidance, usually from a manual or handbook. During the sixteenth century there appeared at least fifty-seven editions of four different treatises on the office of justice of the peace. The first, The Boke of Justices of peas, was printed in 1506 and reprinted thirty-one times in the sixteenth century' (Boyer).'The Boke is actually divided into two sharply differentiated sections, the first containing summaries of statutes and the charge, the second, forms of writs of process and of indictments. The startling anomalies about this second section are that in the indictments there are so few references to justices of the peace and that some of the offences, high treason for example, are not even within their jurisdiction' (Putnam). The 'Charge' is mostly in English and details a Justice's responsibility to make enquiry into heresy, false coin, murder, rape, robbery, desertion of soldiers, extortion, riot, etc. Also covered are, for example, the cutting of roadside hedges (to discourage highway robbery), and statutes regarding trade standards, wages, and measures. The paragraph on 'unlawfull games' notes that 'no laborer nor servau[n]t of artyfycer shall not playe at the tenys cayles foteball' [tennis, kayles or ninepins, and football]. Citing the statutes of Richard II and Henry IV, this one of the earliest printed references in English to both tennis and football. Although undated, this Pynson edition has often been considered the first (by e.g.Putnam). A similarly rare dated edition of 1506 printed by Pynson's competitor Wynkyn de Worde, is in a near-identical setting in different type, differing most substantially in the title-page: the latter has only the royal arms, while our edition also has the Beaufort device (used by Henry VII and his mother Margaret Beaufort), and the rose and crown. Both the Pynson and the Wyknyn de Worde editions of The Boke were issued with a printing of the 'Charter of fee simple', outlining the terms of land grants and ownership with associated rights and obligations. Pynson had moved to the 'sign of the George' on Fleet Street in 1502; in January 1506 he first began to style himself Printer to the King. Legal printing 'was always to be a mainstay of his trade' (ODNB) indeed law books make up two-thirds of his total output.     In fair condition, on lightly-aged and rolled paper, attached with a rusty safety-pin. ONE: Harington's 'Suggestion'. 5pp., 4to. The document begins with his CV as it relates to England, the last entry in which reads: 'Chairman of Herefordshire Quarter Sessions since October 18, 1880. V[ice]. P[resident]. of Society of Chairmen of Q[uarter] S[essions]. Attends [the Royal Commission] at their request.' The 'Suggestion' follows, beginning: 'Political opinion should be absolutely disregarded & it should be no reason for appointing or refusing to appoint any person as a magistrate, that there is amongst the magistrates with whom he will be called on to act a preponderance of the opinions of any political party. | That the selection of names to be submitted to the Lord Chancellor for insertion in the Commission of the Peace for any county should be in the hands of the Lord Lieutenant as at present'. The document continues along the same lines, and includes a list of six types of persons 'best qualified, by age, education and previous habits of life, to act judicially'. Care should be taken 'to avoid selecting those as to whom there is reason to fear that their judgments might be biassed by the enthusiasm of their opinions on any particular subject - in other words, faddists'. He also considers that 'Chairmen of Public bodies should cease to be ex-officio Magistrates', and that 'Magistrates appointed in the future should always be resident in, or within a prescribed distance (say one mile) of the boundary of, the Petty Sessional Division in which they propose to act'. TWO: Typed Letter Signed (2pp., 4to) to Harington from the Honorary Secretary (signature illegible) of the Society of Chairmen and Deputy-Chairmen of Quarter Sessions in England and Wales, Guildhall, Westminster, 23 April 1910. Headed: 'Royal Commission on the Selection of Justices of the Peace'. The President of the Society, Lord Cross, has returned 'a copy of the evidence which you propose to give before the above Commission' and 'approves of the statement, a copy of which I have nbow sent to the Secretary of the Commission'. He discusses '[o]ne of the objections urged [.] to Chairmen of District Councils, &c., being ex-officio Justices' ('every member of the body is it is assumed anxious to put "J.P." after his name for a year at least'. He also comments on the position in Middlesex, of which he has personal experience, and on 'Justices who sit at Petty Sessions [and] do not reside in the Division'.     ONE: Printed document in the person of King George IV, containing a list of several hundred men appointed as justices of the peace, with extensive manuscript emendations and deletions in red and black ink. (A few names are added, but mostly the names of the dead are struck out.) Dated 16 November [1820] and signed in type 'BATHURST.' The first page is headed 'Extracted from the Commission of the Peace for Northumberland.' Aged and worn, with closed tear along fold-line of second leaf, the bottom corner of which is torn away, resulting in loss from around sixteen lines of text. 4pp, foolscap 8vo. Bifolium. Four pages of close text, with subject described in customary fashion for folding into packet lengthwise on the fourth page: '16th November. 1 Geo. IV. / NORTHUMBERLAND. / Extract / FROM THE / COMMISSION OF PEACE.' Beneath this is the slug 'B. WALKER, PRINTER, / NEWCASTLE.' TWO: Printed document in the person of King William IV, relating to the appointment of justices of the peace. Similar in layout to Item One, but in good condition, lightly aged and folded into packet. Dated 6 November [1830] and signed in type 'BATHURST.' The first page is headed 'Extracted from the Commission of the Peace for the County of Northumberland.' 4pp, foolscap 8vo. Bifolium. Three pages of close text, with subject described in customary fashion for folding into packet lengthwise on the fourth page: '6th November. 1 William IV. / NORTHUMBERLAND. / EXTRACT / FROM THE / Commission of the Peace.' Beneath this is the slug 'B. Walker, Printer, Newcastle.' The list in this case is not so long, but still constitutes around half the text. It contains almost two hundred names of those 'assigned [.] jointly and severally, [.] to keep our peace in our county of Northumberland'. No manuscript emendations. This was originally published in 1638 as The Complete Justice: A Compendium of the Particulars Incident to Justices of the Peace. It was well-received and went through several editions. It was popular in part due to its brief summaries and alphabetical arrangement. It also incorporated data from the treatises of Lambarde, Crompton, Dalton and other authorities. It was thus a handy guide that offered good value to the owner. It is fascinating to us because its subject headings, such as those relating to family law and witchcraft, open an interesting window on English society in the early modern era. To All Unto Whom These Presents Shall Come, Greeting: Know Ye, That We Have Assigned and Constituted, And Do by These Presents Assign, Constitute and Appoint Our Trusty and Well-Beloved [Ebenezer Learned of Oxford Esquire] to be One of Our Justices to Keep Our Peace [In Our County of Worcester, Within Our State of Massachusetts Bay]. Roxbury, April 16, 1778. 15-3/4" x 10-1/2" (40 x 26.7 cm) part-printed document, filled in and signed by John Avery, Jr., Deputy Secretary of the Executive Council of the Province of Massachusetts Bay, large embossed seal to upper-right corner. Moderate toning, faint spotting, horizontal and vertical fold lines. A well-preserved document with remarkable associations. $4,500. * A remarkably preserved appointment issued during the height of the American Revolutionary War. Because Massachusetts had cast off British royal authority but had not yet ratified its formal state constitution (written by John Adams and adopted in 1780), the colony was governed by the 28-member Executive Council of the provincial congress. This document features the bold signatures of 15 Council Members acting collectively as the executive head of state, representing a "who's who" of Revolutionary New England leadership. This commission was granted to Brigadier General Ebenezer Learned [1728-1801]. A seasoned veteran of the French and Indian War, Learned marched a regiment to Cambridge immediately following the Battle of Lexington in 1775 and played a vital role in the Siege of Boston. Promoted to Brigadier General in the Continental Army, he famously commanded a brigade under Horatio Gates at the Battle of Saratoga (1777), where his troops were instrumental in breaking the British lines. Plagued by failing health accelerated by the campaign, he resigned his military commission in March 1778. This civil appointment, dated exactly one month later, represents the home front honoring a broken hero with a vital peacetime magistracy. Handsome period-style paneled calf (by J. May, London), outer sections speckled, raised bands, lettering piece and gilt ornaments to spine, black rules along pastedowns. Light rubbing to extremities, front board beginning to detach but secured by hinge, which is just starting at head. Title printed within ruled border. Light toning to text, somewhat heavier in a few places, rule at lower corner of title page touched by trimming due to printer error. Early owner annotation to front endleaf, early owner signature "John Harris", to head of title page. $750. * First and only edition. According to the preface, this anonymous work is drawn from the most useful parts of Blackerby's Justice of Peace (1711) and Young's Justices, Their Vade Mecum and Cornucopia (1620) with additional material by the author. The ownership signature at the top the title-page is "John Harris". While there are several possibilities when it comes to a relatively common name, this may well be the high-profile merchant and alderman John Harris (b. circa 1725, d. 1801) who served as Sheriff of Bristol twice in the 1770s, as well as being elected Mayor of the city in 1790. John Ryland opined on Harris's mayoralty, saying that when Harris "was chief magistrate of this city in 1790, he was enabled to discharge the duties of that office with great fidelity and respectability, and ever since he maintained the highest character for diligence and uprightness in his civil capacity" (Timothy D. Moderate toning and light foxing, three horizontal fold lines with minor tears at margins, tiny stain near lower right corner. $150. * A fine example of a late eighteenth-century Connecticut writ of execution, this one concerning a levy on the goods and estate of Increase Hoskins by his creditor Cicero Phelps. Should the writ be unsatisfied, the sheriff is instructed to "Take the Body of the said Increase and him Commit unto the Keeper of the Goal [sic] in Hartford."
