Vor allem vier Aspekte werden besonders behandelt: Zunächst wird bei der Festlegung des sachlichen Anwendungsbereichs der Niederlassungsfreiheit gezeigt, daß - entgegen der Rechtsprechung des EuGH - rein interne Sachverhalte in den Anwendungsbereich der Grundfreiheiten fallen. Insoweit hält der Verfasser eine Rechtsfortbildung für geboten, deren Zulässigkeit und Bindungswirkung für die Bundesrepublik er selbst angesichts des Maastricht-Urteils des BVerfG bejaht.
