Inden da nåede han at få rollen som en slags politisk martyr. I januar 1841 holdt han på Falster en offentlig tale, hvor han argumenterede for, at enevælden ikke var god for bønderne. Regeringen kvitterede for de udtalelser ved at fængsle og stævne Lehmann, der endte med en dom på tre måneders fængsel for at have skabt "had og misnøje" mod Kongeloven. Lehmanns fængselsophold blev en sand københavnerbegivenhed, hvor intet blev sparet for at forsøde Lehmanns ophold bag tremmer. Forinden havde han med sine usædvanlige talegaver selv ført sit forsvar ved Højesteret som en ægte dansk frihedshelt.
