Im Europäischen Rech…t taucht der Begriff Betriebsstätte auf dem Gebiet der direkten Steuern lediglich in einigen europäischen Richtlinien auf. Soweit ersichtlich, haben sich bisher allerdings weder die Wissenschaft noch die Rechtsprechung näher mit diesem Begriff befasst. Dies ist umso verwunderlicher, als das Europäische Recht trotz Einstimmigkeitserfordernis und begrenzter Kompetenzen im Bereich der direkten Steuern zunehmend an Bedeutung gewinnt. Die Untersuchung befasst sich vorwiegend mit dem Betriebsstättenbegriff im Unionsrecht, wobei die Annäherung an diesen von den europäischen Grundfreiheiten her erfolgt. In einer Einleitung wird zunächst die Bedeutung des Betriebsstättenbegriffs und des Betriebsstättenprinzips vor dem Hintergrund u.a. der Ãquivalenztheorie erläutert sowie auf die Problematiken Doppelbesteuerung und weiÃe Einkünfte hingewiesen. Im ersten Teil der Abhandlung wird die Ãhnlichkeit zwischen dem sekundärrechtlichen Betriebsstättenbegriff und dem primärrechtlichen Zweigniederlassungsbegriff aus Art. 49 AEUV thematisiert. Dementsprechend widmet sich der Verfasser sodann - als Vorbereitung zur Annäherung an den Europäischen Betriebsstättenbegriff - allgemein den Europäischen Grundfreiheiten und speziell dem primärrechtlichen Zweigniederlassungsbegriff. Ausführlich werden hierbei die Tatbestandsmerkmale des primärrechtlichen Zweigniederlassungsbegriffs analysiert. Der zweite Teil behandelt die Betriebsstättenbegriffe in den die direkten Steuern betreffenden europäischen Richtlinien. Zunächst wird hierzu näher auf die Geschichte und Zielrichtungen dieser Sekundärakte eingegangen. Im Anschluss wird die Frage nach der Existenz eines "Einheitsbegriffs der Betriebsstätte" im Sekundärrecht aufgeworfen. Im dritten Teil der Untersuchung wird schlieÃlich der primärrechtliche Zweigniederlassungsbegriff mit dem sekundärrechtlichen Betriebsstättenbegriff verglichen. Hierbei wird unter anderem auch auf das Verhältnis der Rechtskreise nationales Recht, Abkommensrecht, sekundäres Europarecht und primäres Europarecht näher eingegangen. Der dritte Teil schlieÃt mit der Erkenntnis, dass zur Wahrung des Betriebsstättenprinzips sowie zur Erhà hung der Rechts- und Planungssicherheit Rechtssetzungsbedarf geboten ist.
