Die Regelungen, welche der Gesetzgeber mit § 15 Abs. 2 EStG zum Abgrenzen erlassen hat, sind zu allgemein und ermà glichen keine klare Trennung zwischen Gewerbebetrieb und Vermà gensverwaltung. Weder die von der Rechtsprechung herangezogene "Verkehrsauffassung", noch die "gerichtsbekannte und nicht weiter beweisbedürftige Auffassung" der Gerichte eigenen sich zum Auslegen des Begriffs "Gewerbebetrieb", der gesetzlichen Tatbestandsmerkmale des § 15 Abs. 2 EStG und des Begriffs "Vermà gensverwaltung". Die Fruchtziehungsformel, basierend auf § 14 AO ist zu allgemein. Das Beurteilen der Vermà gensverwaltung mittels der "stets gegebenen zumindest bedingten Verkaufsabsicht" und der "unbedingten Verkaufsabsicht" im Erwerbszeitpunkt verkennt, dass das Verwirklichen einer Einkunftsart nicht von Absichten sondern von erfüllten Tatbestandsmerkmalen abhängt. Zum Abgrenzen greifen die Gerichte teilweise unmittelbar auf die Unterscheidung in Klassenbegriff und Typus zurück, wie sie etwa von Larenz vertreten wird. Der "Gewerbebetrieb" kann als offener Typus oder als Klassenbegriff verstanden werden. Es lässt sich weder aus dem als Typus, noch aus dem als Klassenbegriff verstandenen Gewerbebetieb schlüssig ableiten, warum Immobiliengeschäfte die Vermà gensverwaltung überschreiten. Da das Unterscheiden in Klasse und Typus keine sachlogische Trennung zwischen Gewerbe und Vermà gensverwaltung hervorbringt und dazu noch geeignet ist, sich widersprechende Ergebnisse zu begründen, ist das Unterscheiden in Typus und Klassen aufzugeben. Die Rechtsprechung hat die in § 15 Abs. 2 EStG kodifizierten Tatbestandsmerkmale in Urteilen zum gewerblichen Grundstückshandel derart ausgeweitet, dass sie kaum noch zum Abgrenzen der privaten Immobilienverwaltung vom gewerblichen Grundstückshandel dienlich sind. Besonders auffällig ist dies, wenn eine produzierende Tätigkeit auf dem Bausektor entfaltet wird. Die Nachhaltigkeit wird vom BFH angenommen, weil zum Herstellen eines Hauses viele verschiedene Einzeltätigkeiten am Beschaffungsmarkt erforderlich sind. VeräuÃerungsgeschäfte, welche die Vermà gensverwaltung ausschlieÃen, lassen einen "originären Grundstückshandel" entstehen, womit nicht gesagt ist, dass es sich um gewerbliche Einkünfte i.S.v. § 15 EStG handelt. Der Verkauf nur eines Objekts überschreitet in einem solchen Fall die private Vermà gensverwaltung. Ein "rückbezogener" Grundstückshandel entsteht, wenn Immobiliengeschäfte den Rahmen der Drei-Objekt-Grenze überschreiten. Diese Unterscheidung hat sich in den letzten Jahren in der Rechtsprechung deutlich herausgebildet. Damit gewinnt die Drei-Objekt-Grenze an Bedeutung. Offen bleibt die Frage, wie kurze Haltezeiten zu bewerten sind, also wann eine GrundstücksveräuÃerung einen originären Grundstückshandel auslà st, oder als Zählobjekt in die Drei-Objekt-Grenze einbezogen wird. Um nicht den Anwendungsbereich durch Auslagern von Grundstücksgeschäften auf Personengesellschaften oder Gemeinschaften zu umgehen, werden Personengesellschaften und Gemeinschaften hinsichtlich der Zurechnung der verwirklichten Tatbestandsmerkmale als transparent betrachtet. Jedes von einer Personengesellschaft oder Gemeinschaft verkaufte Objekt ist bei jedem Gesellschafter/ Gemeinschafter ein Zählobjekt. Damit kann im Einzelfall ein ganz erheblicher Objektverbrauch eintreten. Das Zwischenschalten von Kapital- und Personengesellschaften kann als Scheingeschäft oder Gestaltungsmissbrauch gedeutet werden. Insgesamt folgt hier der BFH der Rechtsprechung, die zu Scheingeschäften und Missbrauch auÃerhalb des gewerblichen Grundstückshandels erg.
