Paperback. Condizione: new. Paperback. This book outlines the fundamentals of European civil law for readers more familiar with common law jurisdictions such as Australia, New Zealand, the UK and the US.\nThis fully revised and updated second edition retains the successful structure of the first. The four chapters in Part A provide the general framework, covering the concept and method of comparative law, historical foundations, the concept of a civil code and codification, and the role of legislature and the judiciary. More specific and practical material is provided in Part B, with chapters on the law of contract, the law of tort, labour law, commercial law and court procedure. Part C looks to the future, examining differences between civil law and common law and the impact of the European Union.\nThe focus throughout is on private law, particularly the civil laws of France and Germany, except where European Community law has made inroads into the (private) civil law. Each chapter thus incorporates the relevant materials on European Community law. This book outlines the fundamentals of European civil law for readers more familiar with common law jurisdictions such as Australia, New Zealand, the UK and the US. All significant developments and extensive changes which have occured since the previous edition are detailed. Shipping may be from multiple locations in the US or from the UK, depending on stock availability.

The author stresses the impact of the supra-national law of the European Union upon the national law.It has been well over a decade since Fundamentals of European Civil Law was first published and this new edition details the extensive changes which have occurred since. Significant developments have affected the European legal order at national as well as supra-national levels. At a national level, especially the law of obligations has been the subject of thorough official review in both France and Germany. Obligations, whether in tort or contract, constitute a core part of the grand civil codes of nineteenth century Europe. In Germany the Act on the Modernisation of the Law of Obligations (Gesetz zur Modernisierung des Schuldrechts) came into effect on 1 January 2002. The Act has been hailed as the most sweeping reform of the German civil code to date. In France a similar project to rejuvenate the law of obligations has resulted in the so-called Avant-projet Catala, which was submitted to the government in 2005. At the level of the European Community, the formal adoption of a aaC--Euconstitution for EuropeaaC--a failed. Even so, the Treaties of Amsterdam, Nice and Lisbon all represent major amendments to the Treaty of Rome. Together they have expanded the subject matter of European law and revamped the institutional set-up of the European Union. Consumer protection (including general product safety), in particular, has become a major pre-occupation of the contemporary European legislature. Vranken accommodates all of these and other changes preserving where possible, the format of the book. Thus the civil law is discussed in a manner accessible to a common law audience. 1.9 Centimeters X 14.3 Centimeters X 20.8 Centimeters.

Paperback. Condizione: new. Paperback. The rule of law constitutes the hallmark of contemporary Western society. However, public perceptions and attitudes to the law can vary in space and time. This book explores legal solutions to selected problem scenarios in their broader historical, economic, political and societal context. The focus is on the legal traditions of civil law and common law.\nThe book is premised on the assumption indeed, the conviction that use of the comparative method both facilitates and promotes a deeper understanding of the society in which we live and the rules by which it is shaped. Major threads that run through the book are the relationship between law and morality, the role of the state in regulating human interaction, as well as the relationship between the state and the individual.\nAs a practical matter, the text is divided into 3 Parts. A first Part provides various building blocks for a discussion of the law in action in the second and main Part of the book. A final Part addresses the issue of regional globalisation and its impact on the traditional divide between civil law and common law. An Appendix contains the full text of the Charter of Fundamental Rights of the European Union. Includes a discussion on approaches to carefully selected problem scenarios in the two main Western legal traditions. This book provides an understanding of the society in which we live and the rules by which it is shaped. Shipping may be from multiple locations in the US or from the UK, depending on stock availability.

Aggiungi al carrelloHardback. Condizione: New. This concise yet detailed book explores the historical foundations and modern developments of the ancient doctrine of breach of confidence. The authors show that despite its humble beginnings, stilted development and air of quaintness the doctrine has modern relevance and influence, its sense of 'trust and confidence' still resonating with the information society of today. Topical chapters include, 'Inventing an equitable doctrine', 'Privacy and publicity in early Victorian Britain', 'Searching for balance in the employment relationship', as well as many others. Breach of Confidence will make insightful reading for all those interested in issues of privacy and information, and will appeal strongly to practicing lawyers and judges as well as academic researchers and postgraduate law students.
