En esta materia, formula la aplicación del test del competidor hipotético igualmente eficiente como el test aplicable para establecer la ilegalidad de los precios predatorios y de los esquemas de rebajas y descuentos. Veremos que en precios predatorios el planteamiento ha sido corroborado por la jurisprudencia del Tribunal de Justicia de la Unión Europea en sus pronunciamientos recientes. Sin embargo, no sucede así en el caso de rebajas y descuentos, donde el Tribunal de Justicia en Tomra, ha reiterado que la aplicación a los clientes de precios inferiores al precio de coste por la empresa dominante, no constituye una condición previa para la apreciación del carácter abusivo de un sistema de descuentos retroactivos aplicado por una empresa en posición dominante. Demostramos en nuestro estudio, después de analizar el potencial pro y anticompetitivo de los esquemas de rebajas y descuentos, que para que sean ilegales, el problema no es el precio, sino que a través de su aplicación la empresa en posición dominante está denegado las consideraciones de eficiencia al rival, lo que perjudica la competencia. 480 pp. 21 x 15.
