Kick-backs schädigen sowohl das staatliche Vermögen als auch den Leistungswettbewerb. Er analysiert das Vergaberecht nach Präventions- und Missbrauchspotenzialen sowie die Strafbarkeitsrisiken für an der Vergabe mitwirkende Bedienstete des Auftraggebers. Darauf aufbauend entwickelt er Vorschläge für eine intensivere Bekämpfung von Kick-backs, unter anderem einen Sonderstraftatbestand.
