Für die große Zahl der Vereine ist dies zweckmäßig, allerdings erfordern es nicht wenige - insbesondere religiöse - Zwecke, einem vereinsfremden Dritten entscheidenden Einfluß einzuräumen…. Das ist durch die gesetzlich gewährte Gestaltungsfreiheit gedeckt, wird nach herrschender Auffassung aber durch einen zwingenden Grundsatz der Vereinsautonomie beschränkt. Danach dürfen Selbstbestimmung und Selbstverwaltung des Vereins nicht so weit ausgeschlossen werden, daß der Verein zur bloßen Verwaltungsstelle eines anderen würde. Richtigerweise kann Gestaltungen allerdings schon wegen Art. 9 I GG die Wirksamkeit nur versagt werden, soweit der Schutz der beteiligten (Mitglieder-)Interessen dies erfordert. Dafür genügen die Rechtsinstitute des allgemeinen Vereinsrechts. So entsteht ein Konzept, das den berechtigten Interessen an Dritteinfluß gerecht wird, ohne die Mitglieder schutzlos zu stellen.Die Arbeit wurde ausgezeichnet mit dem W.
