Als Antwort nimmt Christoph Reymann einen Versuch der Maßstabsbildung am Beispiel der Handels- und Verbraucherverträge vor. - Das deutsche Privatrecht ist dreigeteilt in das klassische BGB-Zivilrecht, das Sonderprivatrecht der Handelsverträge und das Sonderprivatrecht der Verbraucherverträge. Dies steht formal dem Gedanken der Einheit des Privatrechts entgegen und gerät mit der Idee der »Gleichheit in Freiheit« in Konflikt. Christoph Reymann sucht nach einem Erklärungsmodell und Revisionsansatz für diese Dreiteilung. Er leitet die Untersuchung mit den rechtshistorischen Grundlagen, einer terminologischen Betrachtung des Begriffs der Sonderprivatrechte und der Herausarbeitung der Systemvorgaben, die von der Rechtsordnungsdichotomie in Privatrecht und Öffentliches Recht und dem Postulat nach einer einheitlichen Wirtschaftsverfassung für das Handels- und Verbraucherrecht ausgehen, ein. Zudem hinterfragt er ausgewählte vertragstheoretische Modellansätze der Literatur und wirft den Gedanken auf, ob die Dreiteilung des Vertragsrechts der Rechtsordnung als Prinzip inhärent ist. Nach der Überprüfung, ob die Drittwirkung oder die Schutzpflichten der Grundrechte bzw. Grundfreiheiten einen Legitimationsmaßstab für die Sonderprivatrechte der Handels- und Verbraucherverträge bieten, formuliert der Autor ein Verbraucher- und Unternehmerleitbild als Legitimations- und Kontrollmaßstab der freiheitlichen Ungleichbehandlung durch Sonderprivatrechte.
