Kirchenrechtliches System auf der Grundlage des staatsrechtlichen Positivismus! - Schoen (1867-1941) studierte an der Albertina in Königsberg, wo er zu einem handelsrechtlichen… Thema promoviert wurde und sich im Jahre 1884 bei Philipp Zorn im Verwaltungsrecht habilitierte. Auf Vermittlung Eduard Rosenthals (1853-1926) wurde Schoen im Jahre 1900 als o. Professor für Staats- und Verwaltungsrecht nach Jena berufen, noch im selben Jahr folgte er einem Ruf nach Göttingen (Staats- und Verwaltungsrecht, Völkerrecht, Kirchenrecht). In Göttingen blieb Schoen bis zu seiner Emeritierung im Jahre 1935. Er orientierte sich methodisch am Positivismus Paul Labands und schuf in diesem Rahmen Standardwerke des Verwaltungsrechts: zum "Recht der Kommunalverbände in Preußen" (1896) oder zum "Deutschen Verwaltungsrecht. Allgemeine Lehren und Organisation" (1913). Auf der Grundlage des Positivismus schuf er auch sein kirchenrechtliches System "durch einen rein normativen Zugang" (Martin Otto), freilich heftig kritisiert von Seiten konfessionell orientierter Kirchenrechtler (Erik Wolf oder seines Lehrstuhlnachfolgers in Göttingen, Rudolf Smend). Zum Nationalsozialismus wahrte Schoen Distanz, sein bekanntester Schüler war Ernst von Hippel.
