The book provides both theoretical and practical examples of how to combine existing law with economic theory to improve case outcomes. The book shows how public enforcers can move beyond the dominant transparency paradigm to an approach where firms have a positive duty to treat consumers fairly and shape their commercial offers in a way that prevents consumers from making mistakes. Over time, this 'fairness-by-design' approach will emerge as the only acceptable way to compete.

Noi possiamo sudare o rabbrividire senza aver sentito prima caldo o freddo, oppure possiamo esperire il tutto. Possiamo camminare o nuotare, inconsciamente o consciamente. Così affetti ed istinti possono guidarci, che ne siamo coscienti o no. Certo, man mano che si sale le possibilità organizzative autonome dei livelli nervosi sono maggiori e possono avere conseguenze più complesse. Ed è del pari vero che la rimozione dalla coscienza si esercita continuamente verso tutti i livelli, quando il processo in atto non esige di essere cosciente o disturba altri progetti operativi. Affidiamo abitualmente agli automatismi le regolazioni del nostro corpo e buona parte della nostra attività motoria. Perché non dovremmo restringere a certi livelli la regolazione della nostra vita istintiva ed affettiva? Sono livelli elevati, con interessanti corrispondenze nella scala animale. Possono benissimo conservare tracce, elaborare, realizzare integrazioni e sintesi di alto valore. Possono quindi costituire un contropotere alla nostra attività diurna cosciente. Possono avere il potere completo nella nostra vita notturna. Visto così, l'inconscio psicanalitico come seconda coscienza, non è quello scandalo che per qualcuno sembrerebbe ancora essere.
