THE FIFTH book / pamphlet by Sir Thomas Mainwaring is AN ANSWER TO SIR PETER LEICESTER'S ADDENDA.51 PAGES All five of the books / pamphlets are published in 1673 except the title page of the last one is dated 1673 with also a 4 printed beneath the 3, both in much smaller typeface; the three books by Mainwaring were all published by Sam. Lowndes and the two by Leicester appear to be self published; brown contemporary full calf; double rule borders and leaf design in gilt on both front and rear covers; four raised bands; spine lettering in gilt on a brown leather label, all gilt is bright; inner joints are cracked but the hinges with the publisher's original cloth webbing and originall sewing threads remain strong; book plate and coat-of-arms of John Smith Barry, Marbury Hall, Cheshire on front paste down; Marbury Hall was a country house in Marbury, near Northwich, Cheshire, England; several houses existed on the site from the 13th century, which formed the seat successively of the Marbury, Barry and Smith-Barry families until 1932; the house was demolished in 1968, and the grounds now form part of Marbury Park. Sir Thomas Mainwaring, 1st Baronet (1623-1689) was an English politician who sat in the House of Commons in 1660; Sir Peter Leycester [sic], 1st Baronet (also known as Sir Peter Leicester) (1614-1678) was an English antiquarian and historian. He and Mainwaring who were cousins, had an ongoing dispute producing numerous pamphlets regarding Amicia an ancestor; in 1675 the justices itinerant at Chester assizes declared in favour of Amicia's legitimacy; the title pages in the three works by Mainwaring are rubricated. NOTE: Hugh de Keveliok (Hugh Cyveliok in the Book) was the fifth Earl of Chester (1147 - 30 June 1181). He had six children. Hugh also had another daughter, Amice of Chester, who married Ralph de Mainwaring and was the ancestress of that family. There is no record of Amice's mother or whether she was Hugh's wife or mistress. The question of Amice's legitimacy has been subject to a longstanding dispute.

"Like his father, Mainwaring loved books and cultivated learning. Between 1673 and 1679 he and his kinsman Sir Peter Leycester exchanged insults and arguments in print over the illegitimacy of their remote common ancestress, Amicia, daughter of Hugh of Cyfeilog, earl of Chester, alleged in Leycester's Historical Antiquities (1673) and denied by Mainwaring. Eventually their arguments ranged over much of the social and political life of the twelfth century, and in so doing represented a milestone in historiography. These antagonistsboth possessed of legal training, antiquarian zeal, and significant personal munimentswere able to urge each other, and occasionally themselves, to interpret twelfth-century material from the viewpoint of a twelfth-century nobleman, and not as a quaint aberration" (ODNB). Amicia, the author's grandmother, was the wife of Ralph Mainwaring. Leicester, another descendant of Amicia, claimed that she was a bastard in his Historical Antiquities (1673), and a long, vicious pamphlet war ensued. (The issue was eventually decided in Mainwaring's favor.) This tract, like the others, is of legal interest for its extensive historiographical discussion of the early common law authorities on marriage. Both authors had been students at Gray's Inn. A presentation copy of the sole edition of antiquary and politician Sir Thomas Mainwaring's (1623-1689) primary contribution to the lengthy pamphlet war waged with Sir Peter Leycester regarding the illegitimacy of their distant common ancestor, Amicia, daughter of Hugh of Cyfeilog, earl of Chester. Begun in 1673 with allegations levelled by Leycester in his Historical Antiquities, later denied by Mainwaring, the debate raged until 1679 - their historiographic arguments eventually encompassing much of the social and political life of the twelfth century. The recipient of this copy was presumably Sir Edward Lutwyche (1634-1709), judge and politician. That said, aside from Mainwaring and Lutwyche living in neighbouring counties, we have been unable to determine a connection. John Evelyn's copy, presumably acquired after the presentation to Lutwyche, with the twentieth century booklabel marking this as such to FEP, lot number 953 in the second part of the Christies sale of the Evelyn Library, March 1978.
