Condizione: Good. First Edition. Na de Bijbel heeft sedert de late Middeleeuwen geen boek zoveel vormende kracht uitgeoefend op het recht en de samenleving als het Corpus Iuris Civilis. Honderden jaren heeft de wetgeving van de oost-romeinse keizer Justinianus (1527-565) in Europa een allesoverheersende invloed gehad op het Euro…pese recht in de breedste zin van het woord: op de rechtsgeleerde wetenschapsbeoefening, op de rechtspraak, op de vorming van bestuursnormen en tenslotte op de structuur van de civielrechtelijke wetgevingen die in de 18e en 19e eeuw in Europa tot stand kwamen. Tegelijk met de Institutiones kwamen in 533 de Digesta tot stand, een bloemlezing van duizenden fragmenten die waren ontleend aan werken van rechtsgeleerde auteurs uit de klassieke periode van de Romeinse rechtswetenschap. Uit het oeuvre van juristen als Julianus, Papinianus, Paulus en Ulpianus werd een selectie van tekstfragmenten gemaakt; een van de criteria daarbij was de actualiteitswaarde voor het contemporaine onderwijs en de rechtspraktijk. De Romeinse juristen hadden geen belangstelling voor systematische vragen en abstracte beschouwingen, maar lieten zich bij voorkeur leiden door gevallen uit de dagelijkse praktijk; rechtsvinding vond veelal plaats aan de hand van casu?stiek. De in de Digesten verzamelde teksten hebben dan ook het karakter van 'case law'. Het nimmer ge?venaarde rechts- en billijkheidsgehalte van de door hen voorgestane oplossingen heeft hun adviezen een aan tijd en plaats van ontstaan ontstegen actualiteitswaarde verleend, die sedert de receptie van het Romeinse recht in de Middeleeuwen en de Nieuwe Tijd de vorming en de denkwijze van alle juristen op het continent van Europa heeft beheerst. Het Corpus Iuris Civilis, met de Digesten als wezenlijkste en onsterfelijke component, werd aldus de belangrijkste generator bij de geleidelijke formatie van de nationale rechtstelsels die in de 19e eeuw werden verankerd in codificaties. Voor het eerst wordt in een vele jaren omspannende onderneming het Corpus iuris civilis in het Nederlands vertaald en uitgegeven in een kolommeneditie, waarin de Latijnse en de Nederlandse tekst naast elkaar zijn gezet. Het werk richt zicht tot juristen, historici, classici, theologen en allen die zich betrokken voelen bij de antieke grondslagen van ons recht en onze samenleving. Het beoogt een dieper begrip te kweken voor de groeiende unificatie van het recht in Europa door zicht te bieden op de rechtseenheid in het recente verleden, zoals deze bestond op grond van het Romeinse recht. Ten slotte is het bedoeld als een barri?re tegen het geleidelijk verbleken van het besef van de betekenis van de Justiniaanse codificatie als fundament onder de rechtscultuur in vrijwel alle landen in het Avondland. Tegelijk met de 'Institutiones' kwamen in 533 de 'Digesta' tot stand, een bloemlezing van duizenden fragmenten die zijn ontleend aan werken van rechtsgeleerde auteurs uit de klassieke periode van de Romeinse rechtswetenschap.
