Doch auch davor wurde sie bereits von Unternehmen und Arbeitnehmern genutzt und war Gegenstand der Rechtsprechung.1 Sie existiert bereits seit 1975 und wurde u.a. als 'Barlohnverzicht', 'Deferred Compensation' oder 'Gehaltsumwandlung' bezeichnet. Ab dem 1.1.2002 steht dem Arbeitnehmer ein Anspruch auf Entgeltumwandlung zu. Dieser Anspruch wurde im Zuge des Altersvermögensgesetzes (AVmG) eingeführt und durch Art. 9 AvmG mit1a BetrAVG in das Gesetz zur Verbesserung der betrieblichen Altersversorgung eingefügt.2 Neben den bisherigen drei Formen der Altersversorgung (gesetzliche Rentenversicherung, betriebliche Altersversorgung, private Altersversorgung) hat der Gesetzgeber damit eine Mischform zwischen privater und betrieblicher Altersversorgung geschaffen. Die arbeitnehmerfinanzierte betriebliche Altersversorgung wurde damit erheblich aufgewertet. Hintergrund dieser Neuregelung ist auch das Bestreben, dem demographischen Wandel im Arbeitsleben Rechnung zu tragen. Die gesetzlichen Sicherungssysteme werden aufgrund zunehmender Lebenserwartung und geringer Geburtenrate nicht mehr in der Lage sein, ohne einen explosionsartigen Anstieg der Rentenversicherungsbeiträge eine hinreichende Altersversorgung sicherzustellen. Der Gesetzgeber hat daher das gesetzliche Rentenniveau abgesenkt. Um dies zu kompensieren, wurden steuerliche Vorschriften zur Begünstigung von privaten Altersvorsorgeverträgen und der betrieblichen Altersversorgung geschaffen. Damit gilt die sog. 'Riester-Rente' auch für die Entgeltumwandlung nach1a BetrAVG.3Im Folgenden soll zunächst gezeigt werden, unter welchen Voraussetzungen der Anspruch auf Entgeltumwandlung geltend gemacht werden kann. Die individualrechtlichen und kollektivrechtlichen Anforderungen an eine Entgeltumwandlungsvereinbarung werden erläutert.
