Une affaire qui eut un grand retentissement non seulement en France mais aussi à l'étranger au XVIIIe siècle : trois habitants de Chaumont accusés, puis convaincus d'avoir commis un vol dans une ferme et exercé des violences contre le mari et sa femme, avaient été condamnés au supplice de la roue. Avocat général au Parlement de Bordeaux, Dupaty, troublé par cette erreur judiciaire, au demeurant bien éloignée de son ressort, et après avoir soigneusement étudié les pièces du procès, prouva que des cavaliers de la maréchaussée s'étaient rendus coupable du crime. Dans ce libelle il écrivait : « J?attaque l'arrêt qui les condamne dans la forme et dans le fond par les quatre propositions suivantes : la condamnation a été prononcée au mépris des formes prescrites, sans même que les corps du délit fussent constatés, la condamnation a été prononcée sans aucune preuve que les accusés fussent coupables, la condamnation a été prononcée contre la preuve de l'innocence des accusés, la condamnation a été prononcée avec une partialité manifeste de la part des premiers magistrats ».Il ajoutait cet exorde au roi : « Sire, en implorant un autre Code criminel ce n'est point des nouveautés que l'humanité vous demande ni une opération difficile qu'elle vous propose ». Pourtant son mémoire fut condamné par le Parlement de Paris à être lacéré. Dupaty y perdit la considération de ses collègues et devînt un paria au sein de son Parlement. Mais, le 30 juillet 1787 un arrêt du Conseil du Roi réhabilitera les condamnés et ils furent libérés en décembre 1787, quelques mois avant la mort de Dupaty. Bel exemplaire broché.
