The book provides a comparative and transnational examination of the legal rules which form the basis of transactions on financial markets. Analysing the integration of the markets from a legal point of view provides an opportunity to highlight the role of globalisation as the key element favouring the circulation of rules, models, and especially the development of new regulatory sources.The book examines market transactions and the institutes at the root of these transactions, including the type of legislative sources in force and the subjects acting as legislators. The first part of the book concentrates on the micro-discipline of money, debts, payments and financial instruments. The second part goes on to analyse the macro-context of integration of the markets, looking at the persistence of legal barriers and options for their removal, as well as the development of new legal sources as a consequence of the transfer of monetary and political sovereignty. Finally, the book draws links between the two parts and assesses the consequences of the changes at the macro-level of regulation on the micro-level of legal discipline of monetary obligations, particularly focusing on the emergence and growing importance of soft law.

Through a detailed analysis of programmatic attempts to shape behaviour linked to considerations of risk, this book pursues the argument that, whilst Foucault is useful for understanding…power, the Foucauldian tradition - with its strands of discourse analysis, of governmentality studies, or of radical Deleuzian critique - suffers from a lack of clarification on key conceptual issues. Oriented around four case studies, the architecture of the book devolves upon the distinction between productive and repressive power. The first two studies focus on productive power: the management of long-term unemployment in the public employment service and cognitive-behavioural interventions in the prison service. Two further studies concern repressive interventions: the conditions of incarceration in the prison service and the activity of the customs service. These studies reveal that power, as conceptualised within the Foucauldian tradition, must be modified. A more complex notion of productive power is needed, which covers interventions that appeal to desires, and which govern both at a distance and at close range. Additionally, the simplistic paradigm of repressive power is called into question by the need to consider the organising role of norms and techniques that circumvent agency. Finally, it is argued, Foucault's concept of strategies - which accounts for the thick web of administrative directives, organisational routines, and techniques that simultaneously shape the behaviour of targeted individuals and members of the organisation - requires an organisational dimension that is often neglected in the Foucauldian tradition.

As this book demonstrates, steam turbines, bigger guns, mechanical computin…g devices and ever increasing tonnage meant that the Royal Navy was forced to confront many long-cherished beliefs and sensitive social and political issues. By looking at key continuities over the period of 1880-1919 the study explores how the service and its officers attempted to deal with fundamental changes in professional requirements, and how cultural and social values underwent a transformation in the run up to the First World War. In particular the book looks at how the executive officer corps was presented with a revolution in naval affairs. As the Navy was transformed into an industrialized workplace, officers were challenged by an alteration in the 'culture of command' as arrangements carried over from the days of sail began to breakdown under the practical requirements of a steam and steel fleet. The book charts the ebb and flow of the debate and the various ideas put forward to deal with the structural challenges faced by the Royal Navy. The writings of reformers and commentators such as Fisher, Beresford, Corbett, Laughton and Mahan provide the background to the specific problems faced, and are analysed both in relation to the nature of the reforms implemented, and more crucially, the performance of the 'Senior Service' during the First World War.
