Nach dem neuen § 24a AGBG sind auch Klauseln, die nur für einen einzelnen Vertrag formuliert werden (Einmalklauseln), und auch solche Klauseln, die von unparteiischen Dritten vorgeschlagen werden (Drittklauseln), der Kontrolle nach dem AGB-Gesetz unterworfen. Vor allem gilt für Verbraucherverträge gemäß § 24a Nr. 3 AGBG ein besonderer Maßstab der Inhaltskontrolle. Die Auswirkungen des § 24a AGBG auf die Praxis der Klauselkontrolle sind noch weitgehend ungeklärt. Vor allem in bezug auf den Kontrollmaßstab sind zahlreiche Fragen umstritten. Eingehende Erörterungen der Problematik sind bisher jedoch selten. Der Autor versucht diese Lücke zu schließen. Im Vordergrund steht die Untersuchung des geänderten Maßstabs der Inhaltskontrolle.
