Alfred Pernice (1841-1901) studierte in Halle, Göttingen und Tübingen, wurde 1862 in Halle zum Dr. phil. und ein Jahr später zum Dr. iur. promoviert und schließlich habilitiert…e er dort 1867.1870 wurde Pernice zum Extraordinarius ernannt und ein Jahr später zum Ordinarius.1872 nahm er einen Ruf nach Greifswald an und kehrte 1877 an die Universität Halle zurück. 1881 wechselte er nach Berlin, um in der Nähe von Theodor Mommsen zu lehren. Seine umfangreichen, großen Werke sind dem Ius Romanum gewidmet, so sein opus magnum Labeo. Seine Habilitation war dem Privatrecht gewidmet, das sich mit den Grundlagen der außervertragliche Haftung für Vermögensschäden beschäftigt. Insoweit ist der Titel seine Schrift zu eng gefasst, "Die gegenwärtige Schrift soll nur die Grundlage bilden zu einer dogmengeschichtlichen Entwickelung der heutigen Schadensklage. Dies knüpft in bewußter Weise an die lex Aquilia an", so beginnt Pernice seine Vorbemerkung, in der er die Literatur aus dem Bereich des Ius Commune vorstellt. Franciscus Balduin, de lege Aquilia, bei: Heineccius, Jurisprudentia Romana et Attica 1, 239ff. mit einem mehr dogmengeschichtlichen Schwerpunkt Joseph Suarez de Mendoza, commentarius ad legem Aquiliam in: Meermann Thesaurus 2, S. 1ff. Dieses Werk bezeichnet Pernice als grundlegende Arbeit: "eine wahre Fundgrube von Material". Gerhard Noodt, ad legem Aquilia liber singularis: "fein und elegant geschrieben".
