Im Wege nachfolgender Steuergesetzgebung werden Regelungen in Doppelbesteueru…ngsabkommen, die den einzelnen Steuerpflichtigen begünstigen, derogiert, um Steuerausfälle aufgrund von Kapitalabfluß ins Ausland zu verhindern. In Deutschland stellen zumindest 20 II AStG und 50 d I a EStG ein wirksames Treaty Overriding dar. Weder das Völkerrecht noch das nationale Recht bieten dem deutschen Steuerpflichtigen Schutz vor den nachteiligen Auswirkungen von Treaty Overriding. Der Autor widmet sich der Frage, ob das Europäische Gemeinschaftsrecht Normen enthält, die einem Treaty Overriding Schranken setzen können. Besonderes Augenmerk gilt dabei der Niederlassungsfreiheit gem. Art. 43 EGV und der Kapitalverkehrsfreiheit gem. Art. 56 EGV. Insbesondere werden anhand einer Analyse der Rechtsprechung des EuGH folgende Problemkreise behandelt: - Gilt das allgemeine Beschränkungsverbot der Niederlassungsfreiheit auch im Zusammenhang mit direkten Steuern - Gibt es einen gemeinschaftsrechtlichen Begriff steuerlichen Mißbrauchs, aufgrund dessen Treaty Overriding gerechtfertigt sein kann - Was sind die Schranken-Schranken einer solchen Rechtfertigungsmöglichkeit - In welchem Verhältnis stehen Niederlassungs- und Kapitalverkehrsfreiheit zueinander Andreas Musil kommt zu dem Ergebnis, daß die genannten Grundfreiheiten einem Treaty Overriding nicht generell entgegenstehen. Die Niederlassungsfreiheit ist zwar als allgemeines Beschränkungsverbot auszulegen, Steuergesetze können aber aufgrund des zwingenden Allgemeininteresses der Mißbrauchsverhütung gerechtfertigt sein. Dies aber nur, wenn der Gesetzgeber den gemeinschaftsrechtlich zu bestimmenden Grundsatz der Verhältnismäßigkeit beachtet hat. Niederlassungs- und Kapitalverkehrsfreiheit sind, sofern sie kumulativ thematisch einschlägig sind, nebeneinander anwendbar und bilden dann einen doppelten Prüfungsrahmen für nationale Steuergesetze. 253 pp. Deutsch.
