Das parlamentarische Gesetz nimmt in unserem mo…dernen Rechtsstaat eine zentrale Funktion ein. Zudem stellt es das wichtigste Handlungsmittel der gewählten Regierung und des Parlamentes dar. Gute Gesetze tragen dazu bei, dass Konflikte erst gar nicht entstehen oder sachgerecht gelà st werden. Um der Frage nachzugehen, welche konkreten Verbesserungsvorschläge es im politischen Raum gibt, wird erà rtert, was gute Gesetzgebung überhaupt ist und ob es eine Verfassungspflicht zum guten Gesetz gibt. Ein Gesetz ist ein "gutes" Gesetz, wenn es bestimmte Anforderungen erfüllt: Es sollte in jedem Fall erforderlich und notwendig, eindeutig und widerspruchsfrei, verständlich und bürgernah, praktikabel und vollzugstauglich, vollständig und systemverträglich, einheitlich und funktionsgerecht sein. Auch sollte es das dem Gesetz zugrundeliegende Problem sachgerecht und unter strikter Wahrung des VerhältnismäÃigkeitsgrundsatzes bewältigen. Diese Pflicht ergibt sich bereits aus Art. 20 Abs. 3 GG i.V.m. Art. 1 Abs. 3 GG und ist als verfassungsrechtliches Gebot für alle Staatsgewalten verbindlich. Auch kà nnte ein Gesetz ein "gutes Gesetz" sein, wenn es verfassungskonform ist und vor dem Bundesverfassungsgericht standhält. Die Thematik der Guten Gesetzgebung hat nicht nur national, sondern auch international in den vergangenen Jahren immer mehr an Bedeutung gewonnen. Die Bundesrepublik Deutschland verfügt über keine nennenswerte Tradition in "Legistik". Ob die handwerkliche Qualität der Gesetzgebung dadurch tatsächlich "besser" wird, ist allerdings fraglich. Die deutsche Rechtsordnung muss sich zunehmend dem internationalen Wettbewerb stellen. Eine gute Gesetzgebung kommt auch der deutschen Wirtschaft zugute: Denn die Attraktivität der Bundesrepublik Deutschland als internationaler Wirtschaftsstandort für die Ansiedlung von ausländischen Unternehmen und der Erfolg deutscher Unternehmen hängen maÃgeblich ab von dem rechtlichen Handlungsrahmen, in welchem sie sich bewegen müssen. Gute Gesetzgebung ist ein Affront an alle am Rechtssetzungsprozess Beteiligte: Denn die Verantwortung für Gute Gesetzgebung müssen alle am Rechtssetzungsprozess unmittelbar Beteiligte wie die Ministerialbürokratie, die Bundesregierung und das Parlament tragen. Gute Gesetzgebung ist demnach eine Herausforderung für Parlament und Regierung und kommt in erheblichem MaÃe auch der Rechtsprechung zugute, indem sie sie entlastet.
