This apparent appurtenance (or accession) of groundwater to the land has drastic consequences for what we would now call water rights. As Pomponius put it: "If water which has its sources on your land bursts onto my land and you cut off those sources with the result that the water ceases to reach my land, you will not be considered to have acted with force, provided that no servitude was owed to me in this connection, nor will you be liable under the interdict against force or stealth." This tradition is already reflected in the classic nineteenth-century works of Judge Martin and Charles Gayarré. Although squarely contradicted by the Supreme Court of Luisiana as early as 1816, it is still carried forward more or less routinely by authors with ready access to original Spanish-period sources. Closely allied with the notion that French slave law continued to be applied in Luisiana after OReillys 1769 reorganizations is the more general proposition that French private law, too, remained in effect. This proposition, as well, has had eminent supporters, from Thomas Jefferson to Gustavus Schmidt and, more recently, Colonel John Tucker. Such a radical Francophile view of the legal history of the Spanish Luisiana cannot, however, still be maintained today. The original sources now accessible demonstrate, it is submitted, beyond doubt that OReilly was authorized to change the law of the Province if he deemed it advisable to do so; that he did, indeed, introduce the law of Castile and of the Indies; and crucially, that his actions in this respect received the express approval of his Majesty in Council, and finally, that the judicial authorities of Spanish Luisiana routinely applied Spanish rather than French law between 1770 and 1803. - Hans W.
