Erörtert wird die Zurechnung von Organwissen, die Zurechnung des Wissens unterorganschaftlicher Hilfspersonen und der Problemkreis des Akten- und Computerwissens. Dogmatisch wird die Wissenszurechnung als Problem des Allgemeinen Teils des BGB verortet, der Sache nach geht es um die rechtliche Behandlung arbeitsteiliger Aktivität.Der Autor setzt sich kritisch mit den in Rechtsprechung und Literatur vertretenen Lösungsansätzen auseinander. In Abgrenzung zu diesen entwickelt er auf der Basis allgemeiner Zurechnungsregeln ein neues, weitgehend einheitliches und abschließendes Modell für die Zurechnung des Wissens organschaftlicher und unterorganschaftlicher Hilfspersonen. Das Modell erhebt für sämtliche Wissensnormen und alle Organisationsformen Anspruch auf Gültigkeit. Ob eine arbeitsteilige Struktur - d. h. eine juristische Person, ein Unternehmen, eine Behörde oder eine natürliche Person, die Hilfspersonen einsetzt - juristisch weiß oder nicht, ergibt sich danach jeweils im Einzelfall über ein für Organwissen vierstufiges und für das Wissen unterorganschaftlicher Hilfspersonen fünfstufiges Zurechnungsmodell.
