Por cierto, cada vez que se habla del derecho penal alemán en tiempos del nacionalsocialismo, se menciona a estos autores y a la Kieler Schule casi como única expresión. Nada puede ser más erróneo, e incluso esa idea, que dominó durante muchos años en la ciencia jurídico penal de lengua castellana y en la manualística corriente, permitió que autores políticamente liberales, que bajo ningún concepto podían ser sospechados de cualquier afinidad con el nazismo ni con otras manifestaciones de autoritarismo, divulgasen conceptos bastante peligrosos haciendo caso omiso de sus raíces, pues creyendo que el pensamiento penal nazi era sólo el de Kiel, de allí deducían que el penalismo que se separaba de éste no lo era.
