Sachlicher Ausgangspunkt der Untersuchung ist die Unterscheidung zwischen angloamerikanischen und kontinentaleuropäischen Verfahrenstraditionen sowie die in Praxis und Lehre weitverbreitete Gegenüberstellung der Begriffe »adversatorisches« und »inquisitorisches« Straf- bzw. Beweisverfahren, deren einzelne Bestandteile allerdings bisher nicht in klarer und allgemein anerkannter Weise bestimmt worden sind.Der Autor arbeitet die generellen Ideen hinter derartigen schematischen Gegenüberstellungen in logisch-systematischer Weise auf. Er identifiziert und beschreibt die determinierenden Elemente der Unterscheidung zwischen Idealtypen des Strafverfahrens. Diese Vorgehensweise dient zugleich der funktionalen Rechtsvergleichung als Forschungsmethode.
