Very good. $25. * Published by the famous San Francisco independent bookstore, City Lights Bookstore, and reflecting its countercultural significance, this is an appellate brief, written by Timothy Leary while imprisoned in California. It concerns his 1970 conviction for marijuana possession in the State of California. This memorandum was submitted in support of Leary's application for bail while he appealed his conviction for possessing two half-smoked marijuana cigarettes, in violation of the California Health and Safety Code. At the time of its writing, Leary was already incarcerated at the California Men's Colony-West in San Luis Obispo. This document is sometimes referred to as the "Eagle Brief" and was notably dated the day of his escape from that prison facility in September 1970. This was a separate case from the more famous federal case, Leary v. United States (1969), in which the Supreme Court unanimously overturned his federal conviction under the Marihuana Tax Act on Fifth Amendment self-incrimination grounds. The document you reference relates to his subsequent state-level legal battles.
