By looking into the institutions of the Republic and their history, the study aims at enabling…the reader to make a clear distinction between the institutions and their history as known through antique sources and their representation by modern research. The first major focus of the work lies on the presentation of Roman institutions at the final centuries of the Republic, which we get to know well through a thorough and comprehensive documentation, followed by an analysis of the reliability of the antique sources related to the history of the origins of those institutions since the foundation of Rome. In view of those final times of the Republic, the reinvestigation of inscriptions and other documents allows a better understanding on the transition from the government by decree of the late Republic to the principality that was established by Augustine. The discussion on the numerous problems in view of modern interpretation and theories is treated separately in the chapter "Etat de la recherche." French Description: Cet ouvrage est, depuis la publication en 1927 de l'ouvrage de Leon Homo, Les Institutions politiques romaines, la premiere monographie en langue francaise entierement consacree aux institutions romaines. Le but recherche, dans la presentation proposee des institutions republicaines et de leur histoire, est de permettre aux lecteurs de faire clairement la distinction entre ces institutions et leur histoire telles que nous les connaissons par les sources antiques et ces institutions et leur histoire telles qu'elles sont traitees dans la recherche moderne. Dans ce but, l'essentiel de l'ouvrage a ete consacre d'abord a une presentation des institutions romaines aux derniers siecles de la Republique, que nous connaissons tres bien grace a une documentation tres riche et parfaitement coherente, puis a une analyse de la fiabilite des sources antiques pour l'histoire des origines de ces institutions depuis la fondation de Rome. Druck auf Anfrage Neuware - Printed after ordering - Ce livre porte sur la question toujours controversée de la responsabilité de ceux qui ont condamné Jésus : les Juifs ont-ils livré Jésus à Pilate parce que les Romains leur auraient enlevé la compétence de prononcer et d'exécuter la peine de mort…ou les Romains ne leur auraient-ils pas enlevé cette compétence et auraient-ils livré Jésus à Pilate pour d'autres raisons Ce problème relève du droit constitutionnel lié à l'organisation de l'Empire romain et au statut du peuple juif ; la question est examinée ici sur le plan strictement institutionnel et juridique. Dans les Actes des apôtres et chez Flavius Josèphe, pour des délits contre la loi juive, le Sanhédrin a pu juger et le cas échéant condamner à la peine de mort les accusés sans devoir en demander l'autorisation au gouverneur romain. Inversement, le gouverneur a pu refuser d'intervenir dans des différends qui relevaient de la loi juive. On sait aussi par les Digestes et par d'autres sources romaines que, dans leur juridiction, les gouverneurs de province n'intervenaient normalement que dans les affaires qui impliquaient des citoyens romains ; il existait une tendance à laisser les non-citoyens régler leurs affaires selon leurs lois, même quand il s'agissait de délits passibles de la peine de mort. Dans les Actes des apôtres et chez Flavius Josèphe, pour des délits contre la loi juive, le Sanhédrin a pu juger et le cas échéant condamner à la peine de mort les accusés sans devoir en demander l'autorisation au gouverneur romain. Inversement, le gouverneur a pu refuser d'intervenir dans des différends qui relevaient de la loi juive. On sait aussi par les Digestes et par d'autres sources romaines que, dans leur juridiction, les gouverneurs de province n'intervenaient normalement que dans les affaires qui impliquaient des citoyens romains; il existait une tendance à laisser les non-citoyens régler leurs affaires selon leurs lois, même quand il s'agissait de délits passibles de la peine de mort.
