Erkenntnisse, welche Anstaltsärzte von Gefangenen erlangen, können für die Strafverfolgungsorgane von großem Interesse sein. Allerdings unterliegen auch Anstaltsärzte grundsätzlich der ärztlichen Schweigepflicht. Die Arbeit untersucht in diesem Zusammenhang, ob und wann Anstaltsärzte zu einer Offenbarung dieser Tatsachen verpflichtet oder befugt sind. Dabei werden zunächst die landesgesetzlichen Bestimmungen betrachtet. Darüber hinaus wird114e StPO begutachtet und durch eine Normauslegung dessen Regelungsadressat ermittelt. Im Ergebnis sind Anstaltsärzte nach114e StPO weder verpflichtet noch befugt Erkenntnisse an die Strafverfolgungsbehörden zu übermitteln.
