Es erscheint zunächst als eine luxuriöse Verschwendung wissenschaftlichen Eifers, allzu eingehend in seine Persönlichkeit einzudringen. Tout comprendre c`est tont pardonner. Es haftet dem Psychologen, der den Verbrecher verstehen will, folglich sich zunächst auf seinen Standpunkt stellt oder, wie wir es in unserer Wissenschaft gern ausdrücken, sich mit ihm identifiziert, der Verdacht an, dem Kriminellen helfen zu wollen. Und so gerät der Psychologe in den Verdacht der Illoyalität gegenüber der Gesellschaft. Da die Autoren dieses Buches sich im folgenden diesem Verdacht in reichlichem Maße aussetzen werden, soll ihnen erlaubt sein, zunächst zu beweisen, daß das psychologische Verständnis des Kriminellen nicht in erster Reihe dem Kriminellen hilft, sondern dem Interesse der Gemeinschaft dient. Diese Rechtfertigung wird uns zwar von unserer eigentlichen Aufgabe ablenken, sie wird uns jedoch grundsätzliche Gesichtspunkte für die Notwendigkeit einer psychoanalytischen Kriminologie liefern. Wir dürfen mit dem zunächst nicht bewiesenen Satze beginnen, daß jedes Urteil, das gemeinhin als gerecht empfunden wird, das psychologische Verständnis des Täters, d. h. die Kenntnis seiner Motive, voraussetzt. Die gleiche Tat kann, je nach ihren Motiven, von uns gebilligt oder verurteilt werden. Den Feind im Kriege zu ermorden wird gepriesen, den Angreifer in Notwehr zu töten, wird zugebilligt, in verständlichem Affekt ein Menschenleben zu vernichten, wird manchmal verziehen, der Raubmörder wird einstimmig verurteilt.
