Charles Brown Sears 'was an American law…yer and politician from New York. . . . In 1917, he was appointed by Governor Charles S. Whitman a justice of the New York Supreme Court to fill a vacancy, and was re-elected in November 1917, and 1931. From 1922 on, he sat on the Appellate Division (Fourth Dept.), and was presiding justice from 1927 on. In 1934, he ran on the Republican ticket for the New York Court of Appeals but was defeated by Democrat Edward R. Finch. . . . In January 1940, he was appointed by Governor Herbert H. Lehman to the Court of Appeals to fill the vacancy caused by the election of Irving Lehman as Chief Judge. He retired from the bench at the end of 1940 when the appointment expired and he reached the constitutional age limit of 70 years, thus being barred from seeking re-election. He then served as an official referee of the court. . . . In 1947, he was the Presiding Judge of Military Tribunal IV during the Flick Trial in Nuremberg, Germany. . . . When the Law School of the University [of Buffalo] moved in 1973 to its new building, O'Brian Hall on the North Campus, the law library was named in honor of Charles B. Sears' (Wikipedia). 'The Administration of Justice in Mediaeval France' is printed only on the half-title. Gaunt of Holmes Beach, Fla. reprinted this book in 1970. [a.c.].

Édition originale posthume du premier titre qui donne son no…m au recueil : le Discours des parties et office d'un bon et entier juge fut composé vers 1560 mais imprimé en 1596 à Lyon par Barthélémi Vincent qui le joignit à trois autres pièces de Jean de Coras ici en nouvelle édition, sur l'histoire prodigieuse de Martin Guerre, les mariages clandestins et la traduction des douze règles de Pic de la Mirandole. Chaque partie est précédée de sa propre page de titre qui porte la marque de l'imprimeur. « Si dans la mémoire commune, Jean de Coras (1512-1572) fut avant tout le juge et le chroniqueur de la célèbre cause de Martin Guerre et une des victimes sacrificielles de la Saint-Barthélemy toulousaine, diverses études ont souligné l'intérêt de ses oeuvres qui font de lui une figure marquante de l'humanisme juridique. (?) Il est un des premiers à s'essayer à un genre nouveau : le commentaire en français de la législation royale, avec Des mariages clandestins (1557), plaidoyer en faveur de l'édit de février 1556 où Coras adopte contre l'Église des positions qui sont depuis Erasme, celles des Réformés sur les mariages qui ne sont pas sacramentels. La relation de l' « histoire prodigieuse » d'Arnaud du Thil, le faux Martin Guerre, qui est la trace la plus connue de son activité de magistrat, fut un étonnant succès de librairie mais n'a pas donné matière à une quelconque systématisation juridique. (?) Coras peut faire figure de pionnier de la pensée politique sur deux questions appelées à faire l'objet de débats importants. À une époque où s'installait la vénalité des offices, il écrivit un livre sur les qualités et les devoirs des magistrats : son Discours des parties et office tout empreint d'éthique calviniste tend à promouvoir l'idée selon laquelle le Parlement est le « Sénat de France » et partage avec le roi la même magistrature d'essence divine traduction des douze règles de Pic de la Mirandole. » (Poumarède, Dictionnaire historique des juristes français, p. 203).Provenance : baron Grandjean d?Alteville avec armes et super-libris (ex-libris G au titre, ne figure pas au catalogue de 1862) ; baron Louis Pasquier, ex-libris, (cat. 1874, n° 115).Très bel exemplaire relié par Niédrée. THE RETURN OF MARTIN GUERRE - THE VERY RARE FIRST EDITION OF THE JUDGE'S FIRST-HAND ACCOUNT OF A SENSATIONAL SIXTEENTH-CENTURY TRIAL FOR IDENTITY THEFT; THE BASIS OF NUMEROUS LITERARY, DRAMATIC, AND CINEMATIC ADAPTATIONS. This case had everything - an unhappy marria…ge, a sudden disappearance and a mysterious return, an accusation of impersonation, a possibly complicit wife, a family and a village divided, two dramatic trials, the sudden appearance of a surprise witness at a moment in the second trial when acquittal seemed imminent, a sudden reversal of fortune, the defendant's conviction, his public apology (declaring the wife to be an innocent victim), and his execution in front of the home of the man he impersonated. It is scarcely surprising that the case has inspired, among other things, an essay by Montaigne and one by Leibniz, a novel by Dumas, a short story by Philip K. Dick, an opera, two fine films (a French one starring Gerard Depardieu and an American one transposing the action to the Civil War, starring Richard Gere and Jodie Foster), at least two musicals, and countless historical novels and radio and television episodes. In 1548, Martin Guerre, a French peasant living in the village of Artigat in the département of Ariège, stole a small amount of grain and as a result was forced into exile. This turn of events was doubly tragic for Guerre, because he had just conceived a son after eight years of impotence attributed by him and his young wife Bertrande to an evil spell (maléficiez), and he now had to abandon Bertrande and their newborn child. Eight years later, a man arrived in the village claiming to be Martin Guerre, and he was accepted as such by Bertrande and by the other villagers. He took over management of Guerre's property and had two children with Bertrande, one of whom survived. In fact, the man was one Arnaud du Tilh, who was well-known in his home village as "'dissolute,' a youth of 'bad life,' 'absorbed in every vice.' . He became known as Pansette, 'the belly,' a many with big appetites." (Natalie Zemon Davis, The Return of Martin Guerre, 1983). Suspicions concerning the returned "Martin Guerre" arose among some villagers, particularly Guerre's uncle Pierre, although Bertrande insisted that the man she now lived with was her real husband. In 1559 a soldier passed through Artigat and said that "Martin Guerre" was an impostor - the real Martin Guerre had joined the army of Spain and had lost a leg in battle. When a nearby farmhouse mysteriously burned down, its owner filed a complaint accusing "Guerre" of arson and - probably drawing in information provided by Pierre - of impersonation. Although the complaint had to be withdrawn for lack of evidence, and "Guerre," who had been arrested, was released, the respite was only temporary. Pierre carefully collected additional evidence and launched an inquiry that in due course led to a trial at which "Guerre" - now known to be Arnaud du Tilh, a/k/a Pansette - was convicted in the local court. Arnaud appealed to the Parlement in Toulouse, where his case was heard by the Criminal Chamber, or LaTournelle. This "was one of the five chambers of the Parlement and made up of a rotating group of ten to eleven judges and two or three presidents. Those who happened to be sitting on it for the appeal of 'Martin Guerre' included some of the luminaries of the court, [including] the learned Jean de Coras ." "The Chamber decided that [Coras] would be the reporter for the proceedings, which meant that he would look closely into the issues and finally prepare a report on all the arguments and make a recommendation for the sentence" (Davis, Return). At a dramatic moment in the proceedings, with the court on the verge of finding for the defendant, a man with a wooden leg appeared and stated that he was Martin Guerre. This development dramatically changed the course of the trial; the defendant was found guilty of impersonation and adultery, and sentenced to deliver a public apol.

Cette version française en prose, très augmentée, est l'oeuvre du juriste calviniste Jean de Coras (Toulouse 1513 - Paris 1572), l'un des martyrs de la Saint-Barthélémy, qui fut rapporteur au procès de Martin Guerre. En français réformé. Remarquable impression de Guyon Boudeville, l?un des plus brillants imprimeurs toulousains, mort prématurément en 1562 en raison de ses opinions religieuses. Dès 1555, il abandonne l?orthographe ordinaire pour adopter une orthographe inspirée des théories de Jacques Peletier du Mans et de Ronsard. Il remplace notamment tion par cion et ction par xion ; il bannit le y et le s muet est remplacé par un accent circonflexe (ainsi est est-il orthographié êt), etc. Les livres sortis de ses presses de 1556 à 1559 adoptent tous cette orthographe nouvelle, qui s?inscrit dans les premiers combats pour la langue française au XVIe siècle et l?établissement d?une graphie plus proche de la phonétique. (cf. Nina Catach, L?Orthographe française à l?époque de la Renaissance, pp. 201-202 et 388). Très bel exemplaire, réglé et finement relié par Hardy.
