Hardback. Condizione: New. In this volume, Menno T. Kamminga examines the established doctrine that limits a state's right to invoke diplomatic protection to cases involving its own citizens, arguing that international human rights law has eroded this traditional restriction. Drawing on practice within the United Nations and other international bodies, the study analyzes the procedures through which one state may hold another accountable for abuses committed against any individual. Published as part of the Pennsylvania Studies in Human Rights series, the work contributes to debates on enforcement mechanisms in international law during the early 1990s.

Aggiungi al carrelloCondizione: very good. Antwerp : Intersentia, 2009. Paperback. x, 262 pp. - In academic human rights research, especially legal human rights research, little attention tends to be devoted to questions of methodology. One reason for this may be that human rights scholars often are former human rights activists. Dispensing with methodological niceties enables them to engage in wishful thinking and to come up with the conclusions they were hoping to find in the first place. Furthermore, although much emphasis continues to be put on the need to carry out human rights research from a multidisciplinary perspective, the methods to be applied in such research remain far from clear. Which criteria can be identified to qualify a piece of human rights research as a methodologically sound piece of work? Are there aspects and considerations that are typical for human rights research? What are good practices in human rights research? This book addresses these questions from the perspective of different scholarly fields relevant for human rights research, including international law, criminal law, criminology, political science, comparative politics, international relations, anthropology; philosophy, and history. Aggiungi al carrellopaperback. Condizione: Good. Our good condition books are generally good for reading but not for gifting or collecting. They could have imperfections such as creasing, fanning, inscriptions, margin notes, yellowing, staining on edge or cover or pages, bumps, scuffs, etc etc (sometimes multiple of these). It's a wide category that encompasses anything that isn't almost-new down to anything that is slightly better than poor. We would NOT recommend gifting Good books - these should be considered reading copies. Our books are dispatched from a Yorkshire former cotton mill. We list via barcode/ISBN so please note that the images are stock images and may not be the exact copy you receive, furthermore the details about edition and year might not be accurate as many publishers reuse the same ISBN for multiple editions and as we simply scan a barcode or enter an ISBN we do not check the validity of the edition data when listing. If you're looking for an exact edition please don't order (at least not without checking with us first, although we don't always have time to check). We aim to dispatch prompty, the service used will depend on order value and book size. We can ship to most countries, see our shipping policies. Payment is via Abe only.

(Maastricht series in human rights, 2). - Be as it is the result of the war on terrorism, foreign military intervention, economic globalisation or otherwise, state conduct increasingly affects the human rights of individuals beyond its own borders. This book provides a comprehensive answer to the question whether existing human rights treaties are applicable in such circumstances. The principal treaties on civil and political rights require states to guarantee certain human rights to persons 'within their jurisdiction'. What is the meaning of these terms? Are states able to evade the application of these treaties by detaining their opponents on foreign soil rather than within their own borders? Does it make a difference to the applicability of these treaties, whether a victim of an extraterritorial assassination by state agents, was a detainee, who had not been arrested? By contrast, treaties on economic, social and cultural rights tend to specifically to provide that states must strive for the full realisation of these rights through international co-operation. The problem here is that the precise nature and content of this obligation is unclear. For example, what is the extent of states' obligations to contribute to sustainable development in other states? What are their obligations as members of the executive bodies of international financial institutions such as the World Bank and the IMF? This book focuses on the extraterritorial application of four key human rights treaties: the two UN Covenants on Human Rights and the American and European Conventions on Human Rights. It reveals that supervisory bodies are inconsistent in their implementation of these treaties and discusses the pros and cons of both a restrictive and a non-restrictive approach. Aggiungi al carrelloHardback. Condizione: New. Menno T. Kamminga challenges one of the cornerstones of classic international law: the presumption that states are entitled to exercise diplomatic protection only on behalf of their own nationals. Kamminga systematically reexamines this position, arguing that if a state violates its international human rights obligations, other states are entitled to exercise full protection on behalf of the victims, regardless of their nationality.
