Haase. - Author's name handwritten on cover, otherwise clean. - From the text: When enumerating the sources of Roman law the jurists Gaius, Pomponius, and Papinian did not unclude res iudicatae, judgements in earlier cases to be used as precedents, in their lists of sources. Similarly, in the Roman juristic literature judicial precedents, aside from those set by the emperors, have only a slight role. Thus the standard doctrine of Roman law is that expressed by Justinian, non exemplis sed legibus iudicandum est. The papyri from Egypt of the principate, however, show a striking contrast. Attention was first given the matter about sixty years ago when EgonWeiss observed that in the papyri in which a question of law is raised, the most common documents cited are not statutes or edicts, but decisions in earlier cases. Later H. F. Jolowicz reviewed the question and concluded that there existed a definite practice of citing decided cases as authority in courts of law, that judgements were sometimes expressly based on such authority, and that the practice was facilitated by the use of official dairies and collections made from the reports that they contained.
