COCCEJI (1679-1755) hat entscheidend den Beginn der Justizreform des Aufklärungszeitalters in Preußen mitgeprägt. Nach dem Studium der Rechtswissenschaft an der Universität Frankfurt an der Oder trat COCCEJI im Jahre 1704 in den prußischen Justizdienst. In den Jahren 1711 bis 1713 war er der Vertreter Preußens an der Visitation des Reichskammergerichts. In dieser Zeit entstand aus sein berühmtestes Werk: das "jus civile controversum". Das Werk ist in der Legalordnung der Digesten gegliedert. Innerhlab dieser Legalordnung werden Quaestionen an den Beginn gestellt, die in kontroverser Manier beantwortet werden: Affirm.(andum) - Obj.(ectum) - Resp.(ondum). In der Regel wird an das Respondum noch weitere Gegenargumente aufgereiht, denen wiederum eine Antowrt (respondum) folgt. Samuel de COCEJI, Sohn von Henricus Coccejus, der Minister chef de justice und Großkanzler Friedrichs des Großen, Initiator, Begleiter und Durchführender der großen Justizreform des preußischen Königs, nimmt auch zum Statutarrecht in seinem Hauptwerk Jus Civile controversum Stellung. Mehrfach wird die Frage nach überschneidenden Rechtskreisen gestellt und deren Lösung, etwa bei der Frage: "Ubinam sit locus contractus, si locus expressus non sit?" oder innerhalb des Eherechts: "An maritus forum suum mutare possit in praejudicium uxoris?"
