Erste Ausgabe von Schnabels "rechtsphilosophischem Haupwerk", das von der zeitgenössischen Kritik zerrissen wurde! - Schnabel (1791-1857) gilt als typischer Vertreter eines "gelehrten Juristen des österreichischen Vormärz". Zunächst trat er aber als Statistiker in Erscheinung, bekleidete nach seiner Promotion in Wien (1816) einen Lehrstuhl für europäische und österreichische Statistik an der Universität Prag (seit 1817). Erst im Jahre 1835 bezog Schnabel einen juristischen Lehrstuhl an der Universität Prag, mit dem etwas ungewöhnlichen Zuschnitt "für rechts- und staatswissenschaftliche Enzyklopädie, des Naturrechts und praktischen Völkerrechts, dann des österreichischen Strafrechtes" (vgl. ÖBL, 10, S. 352). Freilich hatte sich Schnabel bereits zuvor auch als Strafrechtler ausgewiesen, hier auch durchaus die Statistik und das Strafrecht zu verbinden gesucht. "Die lehramtliche Verknüpfung von Strafrecht und Rechtsphilosophie bestimmte S. aber, auch auf letzterem Gebiete productiv hervorzutreten, und hier ward ihm ein Mißerfolg nicht erspart. Er selbst glaubte seine Schrift 'Das natürliche Privatrecht' (Wien 1842) als eine 'consequente Durchführung des den gegenwärtigen Stand der Wissenschaft bezeichnenden, in der relativ moralischen Rechtsdeduction gegründeten Rechtsprincipes' charakterisiren zu können, er stieß aber auf lebhaften Widerspruch. In der Zeitschrift für österr. Rechtsgelehrsamkeit selbst (1843), deren eifriger Mitarbeiter S., wie wir gesehen, gewesen war, übte Heyßler an dem Werke eine eingehende, schneidige Kritik, welche dem Verfasser nach der philosophischen wie nach der juridischen Seite die Voraussetzungen zu einer solchen Arbeit absprach, und in der zweiten Wiener juridischen Zeitschrift ('Der Jurist', 1843) schloß sich Wildner v. Maithstein diesem Urtheile an" (vgl. Karl Hugelmann, in: ADB, 32, 73-76).
